20.01.2022 On 6 March 2020 the government introduced a superannuation guarantee (SG) amnesty (the amnesty). The amnesty allows employers to disclose and pay previously unpaid super guarantee charge (SGC), including nominal interest, that they owe their employees without incurring the administration component or Part 7 penalty. In addition, payments of SGC made to the Australian Taxation Office (ATO) after 24 May 2018 and before 7 September 2020 will be t...ax deductible. The amnesty applies to SG shortfalls arising from 1 July 1992 to the March 2018 quarter. This amnesty provides you with the opportunity to review your records and correct any errors. If the ATO identifies underpaid SG amounts for a quarter that was covered by the amnesty that you have not disclosed, then penalties and additional interest charges will apply. You will also not be able to claim a deduction for the SGC paid. You must fulfil certain criteria to be eligible for the amnesty and lodge completed SG amnesty forms with the ATO before 7 September 2020. 18.01.2022 Insolvency and Bankruptcy Law Reforms Hello everyone, Times are tough and could get tougher. With the proactive changes announced by the government, the Australian small businesses have been extended a lifeline for, at least, the next 6 months.... These are the main changes: The thresholds for serving a Statutory Demand upon a company or Bankruptcy Notice upon an individual have increased to $20,000.00; The time frame that debtors will have to comply with Statutory Demands and Bankruptcy Notices has increased from 21 days to 6 months; Directors will be provided temporary relief for 6 months from any personal liability for insolvent trading of their companies, where the debts are incurred in the ordinary course of their company’s trading. Their companies though will continue to be liable for those debts. This will help to temporarily relieve the pressure valve in recovery matters, but will not remove the risk of civil action and having to take steps in those actions generally. There will still also be a need for businesses to continue to plan, and act responsibly and constructively in their particular circumstances, with a view to trying all that is reasonably practical to remain viable during and beyond 6 months.
