24.01.2022 The Queensland Government has introduced legislative changes to create a new offence of industrial manslaughter. The government commissioned a review of Workplace Health and Safety, following two shocking workplace incidents at Eagle Farm racecourse and Dreamworld last year that cost six people their lives. Under the proposed laws, the maximum penalty for industrial manslaughter will be 20 years imprisonment for an individual, with a maximum fine of $10 million for a corporate offender.

20.01.2022 Essendon Football Club has pleaded guilty to two charges laid by WorkSafe Victoria for breaching the Occupational Health and Safety (OHS) Act over its handling of the 2012 supplements program. The club is charged with failing to provide a working environment and system of work that was safe and without risks to health. The charges follow a comprehensive investigation conducted by WorkSafe. The organisation said despite the significant public interest in the case, as it was be...fore the courts it could not make any further comment. Earlier this month, the club said it had accepted the charges. The Bombers face a maximum fine of $305,000. The matter will return to Melbourne Magistrates Court next month. See more

17.01.2022 While the number of injury claims in the construction industry has fallen, the costs of claims is rising, which may be reflected in increased premium rates, according to WorkCover Queensland. WorkCover Queensland data shows that in construction, 8720 workers' compensation claims were received in 2014-15 financial year, a reduction of 4.6 per cent from 2013-14. 09.01.2022 Workplace audits to check compliance with new drug and alcohol requirements in the building industry will begin in February. The new requirements are contained in the Building Code (Fitness for Work/Alcohol and Other Drugs in the Workplace) Amendment Instrument 2015, which started on 16 October. The new rule applies to building contractors covered by the Building Code 2013, including contractors working on large Commonwealth-funded building projects.... Contractors will be required to implement a policy that tests for alcohol and other drugs, including opiates, THC, cocaine, benzodiazepines, amphetamines and methamphetamines. A comprehensive policy setting out how the testing will be conducted and the procedures to be followed in the case of a positive test are also mandatory. In the first two stages of implementation, Fair Work Building and Construction (FWBC), who is responsible for monitoring compliance with the Building Code, will educate industry about the change and conduct audits with the view of providing feedback to help contractors comply. In the third stage, FWBC will conduct compliance audits. These will start after 1 February.
