24.01.2022 Attorney-General and Minister for Justice Yvette D’Ath has announced the appointment of three new judges to the District Court. The new appointments are: Geraldine Dann (Southport District Court, commencing 7 September)... Rowan Jackson QC (Southport District Court, commencing 31 August) Jeffrey Clarke (Rockhampton District Court, commencing 31 August) Geraldine Dann has almost three decades experience in private legal practice, having practised as both a solicitor and barrister, the Attorney-General said. She was called to the bar in 2008 and practised in a wide array of legal fields including safety, industrial, employment, contract and regulatory law. Previously, she practised for almost two decades as a solicitor including five years in commercial law practice and seven years at Herbert Smith Freehills. Rowan Jackson QC commenced practice as a barrister in 1998 and took silk in 2015. His broad commercial practice included commercial, contract, insurance, professional negligence, property, disciplinary matters and corporations matters. He has appeared in a broad range of commercial matters in most courts and tribunals as well as in private arbitrations and expert determinations. Jeffrey Clarke has served as a Magistrate in Rockhampton and has been a Magistrate since 2015. He was called to the bar in 1995, his practice focusing mainly on criminal matters in the District and Supreme Courts. He has also acted in personal injury claims, appeals and judicial reviews and is a Past President of the Victims of Crime Association Central Queensland. These three new appointments to the District Court are outstanding legal practitioners who are well respected in Queensland’s legal profession. I wish all three new appointments the best in their new roles.

18.01.2022 WHO IS THEMIS? Themis, replete with her scales of justice, is an Ancient Greek Titan; the personification of divine order, fairness, law, natural law and custom. Her scales of justice are tools used to remain balanced and pragmatic. The statue of Themis that graces the precincts of the QEII Courts of Law, was made by Greek sculptor Maria Papaconstantinou in 1987, and was donated to the people of Queensland the same year by Angelo Efstathis CBE.

16.01.2022 YOU MAY HAVE HEARD your court appearance referred to as a mention what exactly is it? The word mention means to refer to (something) briefly without going into detail. A mention at court is therefore a brief appearance or hearing before a court that informs the court as to the progress of a particular matter. A court may have many matters mentioned before it each day and it is an integral part of the case management system conducted by the courts. Generally speaking, only your lawyer is required to attend each mention, however there are some circumstances when your personal appearance at court is required. If you have a mention coming up and need representation, contact Anne today.

11.01.2022 WHAT IS BAIL? Bail is a solemn promise (or undertaking) to the court made by a person charged with an offence that they will attend court when required. A bail undertaking may have conditions attached to it that are considered necessary to ensure the person charged with an offence attends court and does not commit any further offences while on bail. Common conditions include that the person reside at a particular address and that the person report to the police at regular intervals. Breaching a bail undertaking by failing to appear at court is considered a serious offence as it demonstrates contempt for the court and can have significant consequences when considering future grants of bail. *This is a photograph of Ha Lò Prison or the "Hanoi Hilton" in Hanoi, Vietnam.

08.01.2022 HOW DO I ENGAGE A LAWYER FOR COURT? For many people charged with a criminal offence, the easiest way to engage a lawyer is to apply for a grant of legal aid from Legal Aid Queensland. You can do this by contacting a lawyer of your choice who is willing to undertake legally aided work, or by contacting Legal Aid Queensland directly. You will need to provide various documents for your application to be considered by Legal Aid Queensland. If you are not eligible for a grant of legal aid, you can pay a lawyer to represent you at Court. Most lawyers will ask for payment up front and will be willing to discuss costs and payment arrangements with you. Contact Anne about representation today.
