02.01.2022 I sent some questions to the NHVR regarding CoR and following is the questions with the answers below. The CoR Australia is a RTO which does CoR training and that is all, they arent the NHVR only a Training Organiasation. Subject: CoR Pilot Vehicle Operators... Jack As requested, Really it comes down to do you have control or influence of the transport activity if you do than youre in the chain 1. Does Pilot come under the CoR rules? A pilot is not a named party in the chain (as a pilot), however, we know it is about their activities not their job title that puts them in the chain. If they are scheduling through controlling the hours of work and rest of the driver then it may put them as that part. (Sort of agree but they need to be engaged by the company as a scheduler) 2. If so, under what Category would they be under, Loader-Scheduler-Consignor or Transport Operator? If they are controlling or directing the operations of the heavy vehicle then they may be an operator. (Do not agree, they must be "Directing the USE of" the heavy vehicle, as opposed to directing a heavy vehicle"this would require some sort of management responsibility" over the vehicle.) 3. Is a Pilot Vehicle a regulated Vehicle, which comes under Fatigue, Mass or Maintenance Rules? A heavy vehicle is any vehicle over 4.5t pilots will also be governed by WHS laws regarding fatigue and safe workplaces (However CoR is not part of WHS laws) 4. Is it so that a Pilot is only required under the conditions of OSOM Travel Permit? Yes this is where most of the requirement of a pilot will come from, Under the HVNL, pilots are traditionally used for OSOM as a requirement under guidelines. Kind Regards John Gilbert, OAM A/Executive Director Strategy & Stakeholder Relations National Heavy Vehicle Regulator
