17.01.2022 $500 billion in loans partly based on falsified loan applications, a significant proportion of those through brokers and indeed, bank staff or others in the six degrees of lending separation, total avoidance of the Code of Banking Practice to vet repayment ability and yet ASIC has said there is no evidence of systemic fraud! Beggars belief. Come on Senators Williams and Cameron, get ASIC and the bankers back to your Economics Committee to explain.

14.01.2022 As expected, the Royal Commission is roasting the brokers who recommended bigger loans just so they would earn higher commissions and the banks are looking pretty battered for not checking loan applications, particularly falsified ones. But I dont see anyone putting their hand up, like the CBA did in the Storm case, and saying we were wrong, we will fix it and setting up a resolution scheme like we had there.

08.01.2022 The contractual warranty to assess loan affordability, has been in the Code of Banking Practice since at least 1994. Why are ASIC only taking this bank to task for its practices since 2011 when most of the falsification of loan applications and Code failures occurred before then? Do those victims miss out again?

05.01.2022 NSW has had unfair contracts legislation since 1980 and it has often been the only saviour for victims of loan abuse. Unfortunately, for all the loan victims of the 15 years before 2016, the new legislation is not restrospective. Only ASIC can rectify the damage done but it has steadfastly declined.
