21.01.2022 MURAKAMI/CREAMER - making legal history I spent a lot of 2015 travelling to Palm Island and interviewing witnesses with my friend and colleague Josh Creamer compiling the crucial evidence which formed the basis for the ground breaking racial discrimination case against the Queensland Government. Today Queensland Attorney General Yvette DAth announced that the Government had abandoned its challenge of a recent Federal Court decision that found that Queensland police had be...en in fact racist in its dealings with the community in 2004 arising out of the so-called Palm Island riots. The decision creates Australian legal history and could not have been achieved without Joshs tireless and passionate work and advocacy getting the evidence before the court and out in the public arena. I trained Josh as a solicitor before he was called to the bar and whilst todays decision is a fantastic one for the good people of Palm Island it is also a great example of one person being able to make a very big difference. 11.01.2022 What Does No Fault Divorce Mean? In Australia 38% of all marriages end up in divorce. This alarming figure has much to do with the Family Law Act (1975), which introduced the concept of no-fault divorce. This meant that both parties could obtain a divorce without the need to prove any wrong-doing in court. But is the Family Law Act really a no-fault jurisdiction? 05.01.2022 HANSON Pre-nuptials While visiting Pauline Hanson in jail as her lawyer in the lead up to her successful appeal of her conviction in 2004, I determined that she was a sincere, kind and intelligent person. However, despite my views about her personally I have always questioned her partys policies. One such policy which I very much question and suggest needs a lot more consultation, is the policy announced in the Sunday Mail recently that all new marriages in Australia shoul...d be required to have pre-nuptial agreements. Pre-nuptial agreements are legal in Australia. However, after nearly a decade in advising people about them I can say there is one sure way to erode the trust and love in a relationship and that is for one party to introduce a pre-nuptial agreement. In my experience contractual agreements determining the meets and bounds of a commercial relationship makes sense but there are some things Governments or potential governments should not interfere with and that is the private loving relationships of individuals.
