12.01.2022 I dropped the 12 year old off at school today, as he is still going to school during this stage 4 lockdown here in Melbourne, as my wife is an essential health worker. I must admit for the first real day of the restrictions, I expected a lot less traffic on the road. What did I see is heaps of tradies cars parked at houses and driving around. For those that say that I shouldn't be out either, the walk to school is nearly a 2km one way trip. Maybe I expected more, but when you... get Jim from Jims mowing trying to convince everyone that his business is an essential service, what hope do you have. I will call that for what it is - Jim is just worried he will lose money from his franchises during this 6 week period. Whilst I'm on a rant, what is it with these idiots who think that they have broken no law in Victoria when not wearing a face mask. Ok I take it that these people have no legal qualifications and went to the University of Google to get their legal advice. But section 203 of the Victorian Public Health and Wellbeing Act 2008 states 203 Compliance with direction or other requirement (1) A person must not refuse or fail to comply with a direction given to the person, or a requirement made of the person, in the exercise of a power under an authorisation given under section 199. Penalty: In the case of a natural person, 120 penalty units; In the case of a body corporate, 600 penalty units. mmm...ok, so what does section 199 state? 199 Chief Health Officer may authorise exercise of certain powers (1) This section applies if (a) a state of emergency exists under section 198; and (b) the Chief Health Officer believes that it is necessary to grant an authorisation under this section to eliminate or reduce a serious risk to public health. So to break it down - yes, we are is a state of emergency here in Victoria and the CHO has made it necessary to eliminate or reduce a serious risk to public health with wearing a face mask. So yes, Mr Idiot at Flinders Street station or wherever you are, when the Police ask you why you are not wearing a face mask and you have no exemption, please don't say that you have committed no crime, because you have. By the way those who wonder what the monetary value of a penalty unit in Victoria at the moment is it is $165.22 OK rant over (for now)
