22.01.2022 Good morning, . Whilst you are able to commence a court case without legal assistance you must be very careful.... I have recently had several clients commence court case without obtaining legal advice beforehand. They have relied on their sense of injustice to proceed to recover debts which they are owed. There are at least two sides to every story. Going to the court must always be the last resort where you never know what may be revealed and how the court may consider your case. There are important considerations: 1. Are you in time or is there a limitation period? 2. Do you have the necessary evidence as required by the Evidence Act? 3. Are you recovering from the correct party? 4. Can it be calculated in dollar value or not? 5. Do you have evidence either physical or electronic or is it just one persons word against another? 4. Is your loss worth the stress, time and money required to pursue your case in court? Court proceedings usually consume large amounts of time, money and stress and without proper preparation, the result may well be that your case can flounder and you can be subjected to paying the defendants legal costs. For the uninitiated, it can be like walking into a quagmire. Thats what happened to my clients. In one case I was able to bring the case back on track and identify the correct debtor and establish the required evidence to proceed. In the other case, I was able to negotiate a settlement and minimise my clients losses in a situation where winning was not possible. With the advent of modern medical technology, there is the equipment to prolong the life of a person without the ability to necessarily provide the quality of life which you wish or even find acceptable due to lifestyle choices or medical costs. Such a directive will allow your nearest and dearest to make appropriate decisions regarding your treatment. To make such a directive the following considerations must be made: What are your life values that determine your lifestyle; Who would you like to make your medical decisions; and What are your wishes regarding the place that you wish to live. In response the New South Wales Government enacted the Retail and other Commercial Leases (COVID-19) Regulation on 24 April 2020. This legislation sets out how the landlord of a commercial property is to treat their tenant during this period. The NSW Regulation will be in force for six ...months commencing on 24 April 2020, being the ‘prescribed period’. The landlord and the tenant (being an ‘impacted lessee’ as defined in the NSW Regulation) can be required to attempt to renegotiate the lease in good faith to accommodate the drop in the tenant’s trade as a result of COVID-19. 20.01.2022 Good morning, I have just had a telephone call from a client who asked me: " ?"... The Family Court does not have any power to make orders concerning child maintenance. This is the province of the Child Support Agency a division of the Department of Human Services of the Commonwealth government. In determining the amount of child support one has to pay the Agency takes into account among other things, the rent you have to pay, your income, the other parents income, whether you are receiving any support payments from the government and whether your employment is either full-time or part-time or casual. You can, however, agree to a Child Support Agreement which stipulates an amount that can either be less or greater than what would be calculated by the Child Support Agency or a lump sum. This Agreement must detail how the payments are going to be made and for exactly to which use they are going to be applied. It does not have to address the particular criteria that the Child Support Agency would utilise in making an assessment. It, however, requires full details and that both parties have received independent legal advice as to the Agreement. The Agreement can only be altered or ended with the consent of the parties in writing or as set out in s12 of the Child Assessment Act those matters which would bring the agreement to an end. Such matters, among other things, including the death of the child or one of the parties; a child turns 18 years of age; or the child is adopted. The Child Assessment Act allows for payments up to the age of 18 or the end of high school whichever occurs the earlier but this can be extended according to the wishes of the party in a Child Support Agreement. Whilst I have outlined some of the criteria for Child Support Agreements, it is necessary to consider all the Act to ensure compliance. 18.01.2022 Hello everyone, " , ." Regretfully whilst most people are being respectful, some are using the COVID-19 restrictions to avoid debts owed.... The government has amended much legislation to assist the business to trade through this period. One of the changes is to the time required to respond to a Statutory Demand from 21 days to 6 months. Thus, a relatively easy lever to have companies to respond to outstanding debts has effectively disappeared. This has been evident in both the government and private sector which has seen applications for Windup applications decrease markedly. I continue to successfully recover outstanding money starting with a Letter of Demand and if necessary proceed to debt recovery action in the courts. Whilst I always recommend going to court as a last option, I attribute my continuing success to very careful preparation and ensuring as much as possible I have covered all bases that may allow a debtor to defend. It is very important to show the court the attempts that have been made to settle the debt as courts wish to have matters mediated if insufficient attempts have not been made. I have found most creditors who are approached promptly, will work with you to enable your business to continue trading. Silence is disrespectful and can lead to court action without notice. My advice is to keep an open conversation with your creditors should conditions appear to be affecting your ability to pay invoices or rent. I have found that the majority of people when they have been contacted at the first available time, are willing to negotiate. I have been involved in negotiations for my clients both debtors and creditors as a result of COVID-19. In the majority of cases, the parties have arrived at a suitable arrangement. 08.01.2022 Good Morning " , , ." ... If you have a claim against someone it is very important that you take prompt action to obtain your remedy. Many matters are time-limited by legislation. Whilst the number of matters which are time-restricted are numerous some of the more common include: 1. You must commence a property application within 12 months of a divorce; 2. Recovery of debts must commence within 6 years of the debt becoming due and payable; and 3. An application for unfair dismissal must be lodged within 21 days of the dismissal. Whilst an application may be made to have the time limits extended, it will require very good reasons to explain the delay and usually result in incurring legal costs. With debt, if a debtor has made a part payment even after 6 years the time will extend a further 6 years from that payment. In cases where an unreasonable delay has occurred and you have neglected without a reasonable excuse, a defendant may rely upon the equitable defence of latches. In such a defence the court will consider the actions of a party and whether or not a claim that has been brought to court has been made after an unreasonable time such that it allowed the defendant to reasonably assume due to the delay that the matter had been finalised. The court will need to be convinced by the defendant that: a. The plaintiff knew of the legal remedy; b. That in all of the circumstances the delay in commencing the proceeding was unreasonable; c. That the defendant had acted as a result of the delay such that to grant the plaintiff a remedy would be unfair. Any action you take to remedy any loss must be taken promptly otherwise you may lose the opportunity or be subjected to higher costs if you have sufficient evidence to justify your delay.
