01.01.2022 Good afternoon Recently I received a telephone call from a client who had been recommended to me. "My clients aren't paying my invoices can you help me?"... Debt collection plays an important part of my commercial work. One of the first questions I ask is: What do you supply and do you have a supply contract and guarantee in place. My client is a supplier of internet and website services to many small and medium businesses. He had been immersed in the business and growing it whilst forgetting to put in place the necessary documentation. Unfortunately, there was neither a supply contract or a personal guarantee in place. His biggest debtor was a company. Very often many companies have no or very little assets. There had been many requests for payment and the customer was now not returning telephone calls or emails. The customer had been one of his best customers and my client wanted if possible, to negotiate payment. Unfortunately, when cashflow is tight and people get behind in their payments, they believe that if they work harder, they can trade out of debt. Very often people are embarrassed to be behind in payments. This is the worst thing they can do. It is often the case creditors will do their best to assist to help debtors and find ways to ensure that they can work together to ensure both businesses thrive. I carefully drafted a letter which resulted in successful negotiations where my client recovered the debt and maintained the customer relationship. I drafted a Supply Contract designed for his particular business needs including a Guarantee, which is now in place with all his customers. This will minimise any future payment problems.
