24.01.2022 FBQ1 wants to know whether Will kits purchased from a newsagent are legal or whether they should just go and see the NSW Trustee to prepare a Will? Do you really need a lawyer to do it? Purchased Will kits are legal provided you get the terminology correct and also execute them correctly. One mistake, and you could find your worldly possessions going to the wrong person. Why take that risk? Whilst the NSW Trustee prepares your Will for free, they are paid on your passing by ...taking a percentage of your estate based on what your assets are worth when you die This can be double (or more) what a solicitor would charge. For example, an estate worth $500,000 (which is average these days), the NSW Trustee would charge $12,100 to administer is, whereas a lawyer can only charge $3,558.50 - 1/3 of the price!! 18.01.2022 In order for our Family Law Accredited Specialist Stacey Nugent to maintain her accreditation, Stacey needs to complete 10 hours of family law conferences every year. On the weekend, Stacey attended the College of Law conference in Sydney. Highlights from the conference included: 1. In cases involving major assets, the role of a stay-at-home-mum-has been given more value by a recent court decision which closes the gap to a more equitable division of assets. 2. All parties who... do intend to separate and have significant assets should get legal and financial advice BEFORE they actual separate. One couple who owned a business was able to save themselves $500,000 in tax by getting advice early and putting a tax minimisation strategy in place. 3. If a parent lends a child/ren money for the purposes of buying an asset in that child's name, the agreement should be documented as a loan, rather than as a gift, to prevent a later property settlement dispute involving the parent as a third party should the child marry and later separate and the interest of the parent becomes a dispute. 15.01.2022 NEW BICYCLE LAWS EFFECTIVE 1ST MARCH 2016 * Riding without a helmet: $319 fine (used to be $$71) - it does not matter how far you are riding. Due to the large fine, the police will no doubt target this. Do not think you can quickly ride down to the shops anymore without a helmet. * Riding through a red light: $425 fine (this happens in the city a lot) * Weaving in and out of traffic (deemed dangerous): $425 fine * Not stopping at a pedestrian crossing: $425 fine... MOTORIST * When travelling at 60km/hr or less (think the main street), you now must leave a 1m buffer between you and a bicycle rider = $319 fine & 2 points * If are travelling more than 60km/hr (eg highway), you must leave a 1.5m buffer. If you have a Court matter whereby the punishment is a jail term (meaning the offence you have committed is serious), then dependant on your income level, Legal Aid provides a Duty Lawyer scheme and may be able t...o represent you (for free). 10.01.2022 Due to lack of government funding to pay for even a casual or part time Clerk of the Court, the Tenterfield Court House will now only be open Tuesday, Wednesday and Thursday every second week (when court is on). 04.01.2022 The Court handed down its first Interlock Drink Driving decision today since the new laws were introduced in February. Interlock is the device you fit to your car that you have to blow into before you can start your car. The Court can make an Interlock Order for any high range drink driving offence. In this case, the offender was detected through an RBT. He had no prior convictions. He was fined $800 and was disqualified for driving for 6 months. After 6 months, he can choose... to fit an Interlock device which costs about $2000, and then he can have an "interlock licence" for the next 2 years. After 2 years, he gets his normal licence back and the interlock device is removed from his car. OR, if he chooses not to fit the device, he will be disqualified for a further 5 years.
