18.01.2022 The Coronavirus Does Not Suspend Parenting Orders. What should I do if a parent suspends my time spent with the children solely because of the Coronavirus? Firstly, you can request the Western Australia Police to do a welfare check to ensure that your children are cared for safely.... If your time spent is not occurring simply because one parent alleges that there is a need to self-isolate, you may be able to apply to the Family Court of Western Australia to enforce your time spent orders. This can be done an urgent basis to ensure that you spend school holiday time or regular weekly time pursuant to your Family Court Orders. In addition to compliance with the existing Orders, you may be permitted to have make up time for any lost time. The Chief Justice of the Family Court of Australia has made it clear that the Courts will take immediate and decisive action to redress non-compliance with the time spent orders during this period. 17.01.2022 To Our Valued Clients Hoping that this update finds you well. Further to my previous emails and given the recent change in Government restrictions due to COVID19, we have made changes to our operating arrangements as follows: Our office has reopened for appointments. Please call 6196 0401 if you need to make an appointment.... Social distancing is still very important, so forgive us if we dont shake your hand when we meet you, or if we sit further away from our desks than normal and ask you to do the same we are responding to the government guidelines to inhibit the spread of the virus. We invite you to use hand sanitiser when you enter our office and before you leave there is a bottle in reception. Due to the size of our offices and social distancing requirements, we request that only one support person attend our office with you. If more than 1 support person accompanies you, they will be asked to wait outside. All of our solicitors, and most of our support staff, are currently working remotely at least some of the time, so you may not be able to see your favourite staff member if you just pop in to the office. We have implemented a roster so that the number of staff in the office at any one time is limited. This does mean that solicitors are not available for in office appointments every day, but only on their rostered days. Your solicitor will still be available for phone and video appointments on their other work days. Please do not attend the office, for any reason, if you are ill or have been in contact with anyone arriving from overseas (including cruise ships) who has not yet finished their 14 days of isolation, or if you have been in contact with a known COVID-19 case, unless you have completed your self isolation period. Please do not be offended, we are committed to keeping our clients and staff safe. We will still ask that you to make payment of your invoice, or requested trust funds, by bank transfer our details are on the reverse of your invoice. If you attend to pay by card, we will ask you to tap, though you may still need to enter your pin. Please do not bring us cash unless you have no other method of paying us. If you wish to pay by card, please call 6196 0401 and we can take your details over the phone. Our phone lines are still being answered remotely and it will not be possible to be put through to your solicitor. Our receptionist will take a message and pass that on. Your lawyer will get back to you. Most Courts in WA are closed for paper filing and are conducting hearings by phone or video conferencing wherever possible. Some hearing types have been cancelled altogether for the immediate future. Your lawyer can give you more information about this. I will provide further updates when necessary. 14.01.2022 For those buying and selling property, the ATO has made changes to the capital gains withholding threshold - From 1 July 2017, all contracts for the sale of property where the consideration value is greater than or equal to $750,000.00, will require a clearance certificate from the ATO. If the clearance certificate is not received, then the purchasers settlement agent is required to retain 12.5% of the sale price at settlement and remit those funds to the ATO. Clearance certificates must be produced by all sellers, regardless of nationality, origin or resident status. Contracts entered into before 1 July 2017 will continue to be subject to the original $2 million threshold and 10% rate even if they will be settled after 1 July 2017.

12.01.2022 There is good news today, for those needing access to free legal advice in WA. The State Government has allocated $165,000 a year, over three years to strengthen pro bono legal services to disadvantaged and vulnerable people in WA via the new WA Pro Bono Model, which comes into effect on July 1, 2020. This funding is in addition to existing State and Government legal assistance programs such as Legal Aid, Community legal centres and the Aboriginal Legal Service. It is hoped that the WA Pro Bono Model, will enable Law Access to assist community legal centres and their clients to be able to access the legal help they require. Settling electronically helps streamline the conveyancing process by:... Reducing the chance of delays. Eliminating the need for you to personally attend our office to sign certain documents. (If purchaser) Eliminating the need for you to obtain bank cheques for settlement. (If vendor) Processing your sale proceeds to your nominated account as cleared funds, so you dont have to wait for a bank cheque to clear. 12.01.2022 SIMPLIFYING DEDUCTIONS FOR WORKING FROM HOME The Morrison Government welcomes the temporary arrangements announced by the Australian Tax Office (ATO) to make it easier for Australians to claim deductions for working from home due to COVID-19. Taxpayers working from home may now claim a rate of 80 cents per hour and will only be required to keep a record of the number of hours they have worked from home, rather than needing to calculate specific running expenses. The short cut... deduction method will make it easier for many Australians who are working from home for the first time due to COVID-19 when it comes to accurately completing their tax return. These arrangements have been put in place for expenses incurred between 1 March 2020 and 30 June 2020. The ATO has undertaken to review these arrangements in line with COVID-19 developments to see if they are required for the next financial year. Todays announcement is yet another demonstration of how every arm of government is working to keep Australians in jobs and businesses in business, and to build a bridge to recovery on the other side. These new arrangements do not prohibit Australians from making a standard working from home claim using the two standard approaches should they wish to do so. 11.01.2022 Magistrates to Hear Matters Statewide All criminal matters in Western Australia will now be heard by Magistrates rather than by Justices of Peace. The decision to implement a centralised Magistrates Court is in line with recommendations from key stakeholders that the increased availability of video conferencing and telephone conferencing means that a Magistrate can be present in any Court across the State and that decisions relating to a person’s liberty, in particular, should be made by persons with legal qualifications, wherever possible. Although Justices of Peace will be stepping back from their judicial duties, they will still be able to authorise search warrants for the time being if they have received the appropriate training. 10.01.2022 In the past weeks we have had many enquiries about compliance with obligations under Parenting Orders and Parenting Plans, in light of the new directions set out by the Government in response to COVID-19. On 31 March, directions were published under section 56 of Emergency Management Act 2005 (WA) which address some of these concerns, particularly with respect to interregional travel. These directions come into effect as of 1 April 2020. The relevant parts of the directions ...are as follows: Direction 4: A person must not enter a region from another region except to the extent that: c) it is necessary for the person to do so for the purpose of being the primary carer for a family member or someone for whom the person has primary caring responsibility; or f) it is necessary for the person to do so for the purpose of: i) attending primary, secondary or tertiary education (including technical and further education) as a student; or ii) enabling the education of someone for whom the person has parental or other primary caring responsibility; (g) it is necessary for the person to do so for the purpose of fulfilling their obligations under a parenting plan, parenting order of a court or other parenting arrangement. We have heard of various parents exploiting the current situation to prevent a childs access to the other parent and ask all our clients to first consider the childs safety, but to also consider the best interests of their children, and the importance of a relationship with the other parent, when assessing whether handover arrangements are appropriate. Our thoughts are with everyone through this confusing and difficult time and hope that this post provides some level of clarity to you and your family. See more

06.01.2022 In an attempt to protect victims of family and domestic violence and those more at risk during the Covid-19 crisis, new laws have now been introduced to allow victims to apply for Restraining Orders online in a quicker and safer way without having to attend a Court Registry. Applicants can obtain assistance with their online application from registered legal services including Legal Aid WA and other community legal services. Once the application is lodged, the applicant will be allocated a hearing date. However, those who cannot attend Court because they are immunocompromised or in quarantine, can make an application to the Court to attend by other means. Once an Order is granted, the applicant can then be informed electronically. Please follow the link below for the media statement on the issue.

06.01.2022 Thought about revising your Will? You should consider updating your Will if any of the following apply to you: if you have married or divorced since your Will was executed; if you have separated from a former partner named in your Will; if you wish to change your executor/s;... if your intentions or circumstances have changed; if you have established a business, a company or Family Trust; if the structure of entities in your current Will has changed; the death of an executor or beneficiary; a change in ownership of any specific gift listed in your Will; if your name has changed; or you are unable to locate your original Will A change of address for yourself, or another beneficiary does not necessitate the amendment of your Will, however, if significant details have changed for multiple beneficiaries, an amendment may make the job of your executor easier. It is prudent to revise your Will every 3 years. While this may not mean that your Will needs to be amended this frequently, jk legal recommend that you consider the above list every so often, to decide whether an amendment may be necessary. We also strongly advise that you check where your current Will is kept, and that your executor is aware of its location. If, after considering the above list, you believe a revision of your Will may be necessary, please call the firm to make an appointment. 04.01.2022 The WA Parliament today passed legislation to assist victims of family violence. I attach an excerpt from the Media Statement released by the Government. New laws to protect family violence victims during COVID-19 pandemic Thursday, 2 April 2020... Current crisis creates heightened risk for victims of family and domestic violence Perpetrators of family violence are using the virus as a method to control and coerce victims New laws will bolster justice system preparedness and response to the spread of COVID-19 These laws will help victims across Western Australia The McGowan Government has moved swiftly to bring into force important laws to protect victims of family and domestic violence, who are at an increased risk during the COVID-19 pandemic. Urgent amendments to the Sentencing Act 1995, the Sentence Administration Act 2003, the Bail Act 1982 and the Restraining Orders Act 1997 passed through both Houses of State Parliament today. The changes include: allowing the court to impose a requirement that an offender be subject to electronic monitoring under Conditional Suspended Imprisonment Orders and Intensive Supervision Orders; permitting a judicial officer to include, as a home detention bail condition, a direction that an accused be subject to electronic monitoring; improving access to restraining orders, including enabling restraining order applications to be lodged online; creating a separate offence for breach of a family violence restraining order, increasing the penalty to $10,000 from $6,000 and extending the limitation period for prosecuting breach of restraining order offences to two years; and allowing the Family Court and Childrens Court to issue interim restraining orders on an ex-parte basis, in the same way the Magistrates Court is permitted to do so. These important reforms will enable the justice system to better respond to the challenges facing victims of family violence during the COVID-19 crisis.

02.01.2022 Reformed Fines Enforcement Regime for Western Australia There have been significant changes to the way fines are being enforced and recovered with the passing of new legislation on 16 June 2020. One of the key changes will be that imprisonment for non-payment of fines is restricted so that imprisonment can only be ordered by a Magistrate and as a sanction of last resort. Further amendments include the introduction of garnishee orders enabling the Sherriff to issue orders to t...he debtors employer or bank and require them to garnish funds from salaries or bank accounts with provision for a protected amount to remain in their bank account to avoid creating excessive hardship. Hardship takes into consideration mental illness and disability, experience of family and domestic violence, homelessness, drug and alcohol problems and financial hardship. Work and development permits will become an option for debtors experiencing hardship affecting their ability to pay their fine debts. To recognise the disproportion of impact of suspended licences on debtors living in remote areas without public transport and infrastructure the laws will prohibit the issue of licence suspension orders for debtors whose last known address is in a remote area. All unserved warrants of commitment will be cancelled on the day after the legislation receives royal assent however, those debts will not be wiped but the fear of the imprisonment for the fine default for hundreds of West Australians will be removed. The consequence is that there will be a significant reduction in the rate of Indigenous incarceration. See more
