24.01.2022 I think it’s fair to say that the beginning of 2021, has not been the fresh start that people were hoping for. After the previous year of uncertainty and for many a year of distance from loved ones, there was a palpable feeling that the new year would bring with it new hope. At JK legal we understand that life can be hard enough to navigate at the best of times and the additional pressures placed on people due to COVID- 19, the WA lockdown and bushfires, have led to increased... emotional and financial pressure. Whilst our office may currently be closed for face to face appointments, we are busily working from home and ready to assist you with your legal queries no matter how large or small with compassion and understanding. We wish you all a happier and healthier rest of 2021, please stay safe and here is a picture of our office mascots Abbie and Jaffa for anyone who needs to see a smiley face today

21.01.2022 The team at jk legal would like to wish you a happy and safe Easter and thought we would start your break with a little Easter Trivia. Whilst I am fairly certain most people do not think about legislation when they are celebrating Easter, without it there would be no dedicated holiday. The Easter Act of 1929 proclaimed that Easter day shall, in every year, be the first Sunday after the second Saturday in April. This was followed by the Public and Bank Holidays Act 1972 whi...ch gave us the Easter Monday public holiday. There are even laws on what constitutes chocolate! The Australia New Zealand Food Standards Code defines chocolate as a confectionery product that is characterised by the presence of cocoa bean derivatives; and no more than 50g/kg of edible oils, other than cocoa butter or dairy fats; and preparation from a minimum of 200g/kg of cocoa bean derivatives. Then there is the legislation designed to keep people safe over the Easter break which is contained in the Road Traffic Code 2000 with Double Demerits from Thursday 1st to Monday 5th April inclusive. The aim of this initiative is to encourage safe driving on long weekends and public holidays. 20.01.2022 This week we would like to introduce you to Jude: Jude has a law degree with honors from Murdoch University and has been in practice since 1998. She started as an Articled Clerk with a Fremantle law firm, became a partner there in 2003, resigned in 2007, travelled, picked grapes and flowers and then took up law again at a firm in Albany in 2008. In 2011, Jude opened jk legal in Armadale. Jude’s approach with clients is to be calm, understanding and compassionate and she endeavors to keep clients focused on what is real and important in the usually emotional area of family law. Jude also holds a Bachelor of Commerce and is a member of the Family Law Practitioners Association of WA, the Law Society and the Family Law Section. Outside work Jude has a passion for fitness and nature and is hoping to learn hip hop dancing this year.



17.01.2022 This week it is my turn to introduce myself. I’m Emily the newest addition to the jk Legal team. I hold a Bachelor of Laws, PLT, an honors degree in History and Spanish and qualifications in community services. I have spent over a decade working in business development and state management roles and I am now in my dream role as a solicitor after being admitted to practice in October 2020. I share my property with my husband and a variety of critters and am at my happiest surrounded by nature. I enjoy meditation, time with family both human and furry and donkey snuggles at Possum Valley Animal Sanctuary. As I am new to the jk team it is hard to pick my favorite part of the role, it’s all exciting. However, the team are pretty incredible and I love getting to work face to face with our clients.

15.01.2022 To Our Valued Clients Hoping that this update finds you well. Further to my previous emails and given the recent change in Government restrictions due to COVID19, we have made changes to our operating arrangements as follows: Our office has reopened for appointments. Please call 6196 0401 if you need to make an appointment.... Social distancing is still very important, so forgive us if we don’t shake your hand when we meet you, or if we sit further away from our desks than normal and ask you to do the same we are responding to the government guidelines to inhibit the spread of the virus. We invite you to use hand sanitiser when you enter our office and before you leave there is a bottle in reception. Due to the size of our offices and social distancing requirements, we request that only one support person attend our office with you. If more than 1 support person accompanies you, they will be asked to wait outside. All of our solicitors, and most of our support staff, are currently working remotely at least some of the time, so you may not be able to see your favourite staff member if you just pop in to the office. We have implemented a roster so that the number of staff in the office at any one time is limited. This does mean that solicitors are not available for in office appointments every day, but only on their rostered days. Your solicitor will still be available for phone and video appointments on their other work days. Please do not attend the office, for any reason, if you are ill or have been in contact with anyone arriving from overseas (including cruise ships) who has not yet finished their 14 days of isolation, or if you have been in contact with a known COVID-19 case, unless you have completed your self isolation period. Please do not be offended, we are committed to keeping our clients and staff safe. We will still ask that you to make payment of your invoice, or requested trust funds, by bank transfer our details are on the reverse of your invoice. If you attend to pay by card, we will ask you to tap, though you may still need to enter your pin. Please do not bring us cash unless you have no other method of paying us. If you wish to pay by card, please call 6196 0401 and we can take your details over the phone. Our phone lines are still being answered remotely and it will not be possible to be put through to your solicitor. Our receptionist will take a message and pass that on. Your lawyer will get back to you. Most Courts in WA are closed for paper filing and are conducting hearings by phone or video conferencing wherever possible. Some hearing types have been cancelled altogether for the immediate future. Your lawyer can give you more information about this. I will provide further updates when necessary. 14.01.2022 In an attempt to protect victims of family and domestic violence and those more at risk during the Covid-19 crisis, new laws have now been introduced to allow victims to apply for Restraining Orders online in a quicker and safer way without having to attend a Court Registry. Applicants can obtain assistance with their online application from registered legal services including Legal Aid WA and other community legal services. Once the application is lodged, the applicant will be allocated a hearing date. However, those who cannot attend Court because they are immunocompromised or in quarantine, can make an application to the Court to attend by other means. Once an Order is granted, the applicant can then be informed electronically. Please follow the link below for the media statement on the issue.



14.01.2022 This week we would like to introduce you to Courtenay, who has been working as a Legal Secretary at jk legal for 2.5 years. She has a Cert 3 in Business Studies and a can do attitude, bringing positivity and professionalism to everything she does. Courtenay enjoys socializing with friends, being outdoors, walking and playing with dogs. She says her favorite things about her role at jk legal are being able to help people, learning new things and gaining experience.

12.01.2022 Reformed Fines Enforcement Regime for Western Australia There have been significant changes to the way fines are being enforced and recovered with the passing of new legislation on 16 June 2020. One of the key changes will be that imprisonment for non-payment of fines is restricted so that imprisonment can only be ordered by a Magistrate and as a sanction of last resort. Further amendments include the introduction of garnishee orders enabling the Sherriff to issue orders to t...he debtors employer or bank and require them to garnish funds from salaries or bank accounts with provision for a protected amount to remain in their bank account to avoid creating excessive hardship. Hardship takes into consideration mental illness and disability, experience of family and domestic violence, homelessness, drug and alcohol problems and financial hardship. Work and development permits will become an option for debtors experiencing hardship affecting their ability to pay their fine debts. To recognise the disproportion of impact of suspended licences on debtors living in remote areas without public transport and infrastructure the laws will prohibit the issue of licence suspension orders for debtors whose last known address is in a remote area. All unserved warrants of commitment will be cancelled on the day after the legislation receives royal assent however, those debts will not be wiped but the fear of the imprisonment for the fine default for hundreds of West Australians will be removed. The consequence is that there will be a significant reduction in the rate of Indigenous incarceration. See more

11.01.2022 We would like to introduce you to our team, starting with Siobhan Fox. Siobhan has been an integral part of the team for just over 8.5 years, she is a licensed settlement agent, legal secretary and a member of the Australian Institute of Conveyancers WA and PEXA. Siobhan is a Byford local who loves going for long walks and spending time with her family. She is a proud mum of 3 and nanna of 1 and the smiling face that you will see when you come to reception. Siobhan's favorite thing about working at jk legal is the face to face interaction with clients.

10.01.2022 There is good news today, for those needing access to free legal advice in WA. The State Government has allocated $165,000 a year, over three years to strengthen pro bono legal services to disadvantaged and vulnerable people in WA via the new WA ‘Pro Bono Model’, which comes into effect on July 1, 2020. This funding is in addition to existing State and Government legal assistance programs such as Legal Aid, Community legal centres and the Aboriginal Legal Service. It is hoped that the WA Pro Bono Model, will enable Law Access to assist community legal centres and their clients to be able to access the legal help they require. 08.01.2022 Magistrates to Hear Matters Statewide All criminal matters in Western Australia will now be heard by Magistrates rather than by Justices of Peace. The decision to implement a centralised Magistrates Court is in line with recommendations from key stakeholders that the increased availability of video conferencing and telephone conferencing means that a Magistrate can be present in any Court across the State and that decisions relating to a person’s liberty, in particular, should be made by persons with legal qualifications, wherever possible. Although Justices of Peace will be stepping back from their judicial duties, they will still be able to authorise search warrants for the time being if they have received the appropriate training. 07.01.2022 Did you know that jk legal also do free community presentations? Earlier this month we did a presentation at Dale Cottages on Wills, Enduring Powers of Attorney and Enduring Powers of Guardianship. The fully booked talk was very well received by attendees, so much so that we will be back to do another talk at Dale Cottages on contested estates. 06.01.2022 Due to the announcement made today by our Premier that we are entering a 5 day lockdown, our office will be closed and instead, our staff will be working remotely.
