25.01.2022 We have been asked recently -what happens to a buyer's eligibility for transfer duty concessions (first home or home) if the property purchased has an existing tenant with a lease period extending more than 6 months past the transfer (settlement) date? Hopefully this post provides some assistance to all. For all those who have done their own research, you may have read that if a tenant does not vacate the premises at the end of their lease, or within 6 months from the end of ...transfer date (usually this is settlement date), whichever is the earlier, then the buyer will not be eligible for transfer duty concession. Fortunately, the case of Commissioner of State Revenue v Di Sipio & Anor [2015] QCA 198 has provided some clarification on this matter. Basically, as long as the buyer had NOTHING to do with the granting of the lease to the tenant (ie the lease was entered into by the seller prior to the contract of sale), then the buyer's eligibility for transfer duty concession will not be lost.
