Mary graduated from a Bachelor of Law, Bachelor of Social Science (majoring in Criminology and Criminal Justice) and a Graduate Legal Diploma. Upon graduating Mary commenced working as a Graduate Solicitor in Personal Injury law at a specialist compensation law firm. Mary worked in all areas of personal injury law namely motor vehicle accident claims, public liability, workers compensation, common law and total permanent disablement. 12.01.2022 John Fasha Solicitors save an Assyrian from being deported from Australia by the Minister for Immigration in the Administrative Appeals Tribunal: http://www.austlii.edu.au//au/cases/cth/AATA/2020/4254.html WQWS and Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs (Migration) [2020] AATA 4254 (26 October 2020) [7] The applicant is an Assyrian Christian, and for that reason, as well as because he would be a returnee in Syria, the applicant wo...uld be at risk of serious harm, and his life would be at risk. [8] I have found that non-refoulement obligations are owed in respect of the applicant, with the consequence that Australia would be in breach of its international treaty obligations if he were returned to Syria. [30] The applicant’s witness statement was prepared with the assistance of his solicitor and counsel. [50] These matters show that the applicant has a well-founded fear of persecution. [59] In my opinion, the correct or preferable exercise of discretion in this case is to set aside the reviewable decision and revoke the cancellation of the applicant’s visa it seems to me that especially because of the humanitarian considerations the existence of international non-refoulement obligations and the presence of almost all of his family in this country, on balance the discretion should be exercised in the applicant’s favour.
