John Hall Lawyers provides your first family law interview for free, to discuss any issues you may have regarding property law settlements during Covid-19.

21.01.2022 Thinking of leaving your home to one child and your investments to another child under your will? Think again! Tax on your investments may make those assets worth much less on your death than your home is worth. Speak to one of our experienced solicitors and get the right advice about how to make sure your children get the shares in your estate that you intend, preserve the relationships between them and make it less likely that your estate will be tied up for years in litigation.

20.01.2022 How does COVID-19 affect commercial and retail leases? The Federal Governments Mandatory Code of Conduct offers a moratorium on eviction for non-payment of rent, and rent reductions proportionate to the loss of your business turnover. The code will only apply to commercial/retail leases where the business has an annual turnover of less than $50 million, and the business is in financial distress which makes it eligible for the JobKeeper program (i.e. have a 30% fall in revenue since 1 March 2020).

20.01.2022 Did you know that National Road Rules 74 and 75 mean drivers MUST give way to pedestrians on a driveway when drivers are entering or leaving? Drivers DONT have the right of way, pedestrians do. If you hit a pedestrian and youll be charged, risking loss of your licence, fines and being sued for any injury inflicted.

19.01.2022 Is super able to be left under your will? The short answer is no. On your death your superannuation and any associated life insurance passes under the terms of the super fund trust deed as determined by the super trustee. You can make a binding death benefit nomination which takes away the trustee’s decision if the nomination form is completed, signed and witnessed correctly and updated every three years. At John Hall Lawyers we consider all your assets when drafting your will including your super and update your binding death benefit nominations for your superannuation at the same time. Call for an appointment now to update your estate planning documents on 4588 5955 or visit our website for more information. https://www.johnhalllawyers.com.au/

18.01.2022 On your death, super paid to adult non-dependent beneficiaries is taxed at 15%. However, your enduring attorney can, at your direction or in the event of your incapacity, withdraw the super from the fund for you. This withdrawal is not subject to tax, nor is it taxed in the hands of your beneficiaries. But to do this, the Power of Attorney must specifically give your attorney power to deal with your super. John Hall Lawyers will make sure your Power of Attorney is an effective estate planning tool. See us to update your will, Power of Attorney, Guardianship Appointment and super nominations.

However, it is a good idea to arrange this inspection well in advance of listing your property for sale to have the certificate completed in time.

15.01.2022 Legal Costs of challenging a will Several recent decisions of the Supreme Court highlight the huge legal costs incurred in challenging wills. Often completely disproportionate to the size of the estate and exceeding the amount claimed. Before leaving a beneficiary out of a will, take legal advice as to the cost to your estate and the emotional and financial cost to other beneficiaries of the likelihood of a claim by the beneficiary who misses out. Proper legal advice can see you minimise the likelihood of a claim against your estate.
