14.01.2022 Easter Alert - Speeding is dangerous !!! Today you are probably excited and looking forward to an extended break over the Easter period to re-charge the batteries! Many people will be travelling by road to their favourite holiday desitinations such as Busselton, Albany and Esperance to name a few. We hear and see well in advance prior to Easter the Police advertising campaigns and a call for saftey on our roads from our Government.... We really want you to have a safe Easter so we thought we tell you some interesting road rules you should adhere to always and especially over the Easter break. Remember it is double demerit points this weekend !!! If you are going to speed in your vehicle over the designated speed limit by the following you will be liable as follows: 1. Speed less than 9km/h = $75.00 fine - no demerit points (DP) 2. Speed between 9km/h - 19km/h = $150 fine & 4 DP 3. Speed between 19km/h and 29km/h =$300 fine & 6 DP 4. Speed between 29km/h - 40km/h = $700 fine & 14 DP 5. Speed more than 40km/h = $1000 fine & 20 DP We hope you have a great weekend and just remember - you can get done for Drink Driving if you are riding a push-bike or riding a horse. Unfortunately, users can easily fall into the trap of forgetting about who their audience is and who may access and read their Facebook posts. ... We are often called upon to deal with matters involving defamation on Facebook. We are often amazed at what users post on Facebook so we thought we would give you a timely reminder to be careful about what you post on Facebook. What is defamation? No single definition exists, but generally you have been defamed when words have been spoken or written which: injure the respect and esteem you are held in by others injure you in your trade or profession, or are likely to result in you being shunned, avoided or ridiculed The difference between libel and slander has been abolished. There is no longer a need to prove special damage in an action for defamation. Can a person be defamed by Accident or Innuendo? There is no need to prove the person making the statement intended to defame them. If a statement is made which allows a third person to put two and two together and draw a conclusion, or if the alleged defamer says one thing but really means another, or if what he has said has an underlying defamatory meaning, those statements may be defamatory. There are defences to defamation but we suggest you avoid posting any defamatory information on Facebook to start with. If in doubt leave it out! Making a claim will depend upon the type of insurance the you have in place.... There are three main types of insurance for motorists in Western Australia: Compulsory Third Party Insurance Everyone who registers a motor vehicle automatically takes out this insurance at a rate set by the Government. This cost is included in the cost of registration. This insurance covers a person for personal injury claims made against them as the owner of the vehicle, but does NOT cover damage to vehicles or property. Comprehensive Insurance Comprehensive Insurance covers damage to your car, damage to other cars and damage to property. Some policies also cover towing costs, medical expenses and even legal expenses. Different policies offer different coverage so you should consult your own policy to see if your insurance company covers these items. Third Party Property Damage Property damage to other cars is the most common of all insurance claims.This type of policy covers a person only for damage to other vehicles and the property of other people unless it includes uninsured motorist extension. Some Third Party Fire and Theft, and Third Party Property insurance offers this extension. It covers damage to a car up to a set amount if the car is damaged by an uninsured car if you are: considered to be not at fault by the insurer, and can provide the uninsured driver’s name and address. Third Party Property Damage is an insurance option often chosen by people who own a car which is not valuable enough to be worth the cost of comprehensive insurance.
