25.01.2022 From a philosophical perspective Racial Discrimination Acts, in their myriad of form, designed to protect marginalised populous are perhaps limited in the sense that they hold the populous in a state of perpetual dependance. Think about it, does a marginalised race ever become, non-marginalised... That’s the ironical nature of Acts like this - for them to exist, it needs a problem to be solved. 19.01.2022 This 2020 election, like the last, when the New York Times gave Clinton an 85% chance to win, is not over yet. The Trafalgar Group methodology or Social Desirability Bias argued by many, otherwise ubiquitously known as the shy Trump voter may surprise many, again ... let’s see. In one way of thinking, the act of giving an answer based on a socially desirable [ 172 more words ] http://jurisnguyen.com//social-desirability-trump-v-biden/

16.01.2022 April 2020 Pell vs The Queen HCA 12 On 7 April 2020 the full bench of the High Court handed down their decision on the appeal case from the Victorian Supreme Court in Pell vs The Queen.(1) What I'm looking forward to in reading this appeal is the mechanics used by the court in dissecting the aspects of the verdict not being supported by the evidence, as well as the [ 163 more words ] http://jurisnguyen.com/2020/04/10/pell-vs-the-queen/

15.01.2022 After seeing nearly every Barrister around the world on Linkedin post a rather banal obligatory shot of their computer screen I offer my contribution to the "work from home picture". this is not a computer screen Jeremy Mark Holt, Sydney 20/03/20 http://jurisnguyen.com///20/this-is-not-a-computer-screen/

14.01.2022 Sounds prior to and during lockdown - corner of Lafayette and East Fourth Street in Manhattan New York. It's so easy to get dragged into the sea of hysteria regarding just about anything these days. -- - - Everything, these days seems to go 'viral'. But, this is another way to look at the same thing from a totally novel or unique perspective. Also adds as a way of resetting our thinking to tackle the next series of obstacles. #nytimes #newyork #manhattan #philosophy #coronavirus http://jurisnguyen.com/2020/05/24/resetting-the-perspective/

10.01.2022 A very interesting article,(1) regarding the administration of Charitable money in a GoFundMe campaign designed to fund Trump’s wall on the Southern Border originally called We the People Build the Wall. In particular, notably, Stephen Bannon is one of the co-accused. In common law jurisdictions I suppose this would go to misuse of trust funds originally intended for a charitable purpose and involve Breach of Trust if proved. 09.01.2022 Amazing and interesting watching the rhetoric with China US AU relations right now. Oh, I almost forgot Hong Kong! I wonder how the other Oceanic/South East Asian countries are navigating these international waters. The law, as it is, has finite limitations to solve State problems, especially so with regards to how all these countries function politically. http://jurisnguyen.com//25/navigating-international-law-a/

08.01.2022 Is there any more entertaining time than election time in the US? Andy Borowtiz is one of my favorites to follow in his redoubtable 'Borowtiz Report' - follow him for some musings on the upcoming election. And this post on Harris is a pearl - Harris Tells Trump She Cannot Send Him Birth Certificate Without Postal Service. http://jurisnguyen.com/2020/08/18/ahh-election-time/

06.01.2022 Looking forward to moving to Canberra after recently passing the NSW Bar Exam. I believe I was the only candidate from Western Australia to sit the exam. In comparison to the 8 months of preparatory study, getting up at 4am, or being awake until 2am, the exam was easy. When pondering whether to even consider doing the exam I drew a contrast from Kennedy’s speech - doing something, not because it is easy, but because it is hard. 05.01.2022 Effective Persuasion Effective persuasion, rather than trying to convince anyone of anything, is one in which the opposition is unaware they are in fact actively advancing our own point of view. Too often we hear worn our methods of persuasion recycled and repeated again and again without meaning. Which, are often well known and used by everyone. If everyone is using the same technique, it is often counterproductive as it cancels it opposite out. [ 100 more words ] http://jurisnguyen.com/2020/10/28/effective-persuasion/

02.01.2022 It is often the case that legislation can be mesmerising. This is particularly so with regards to the Evidence Act and their various iterations in Australia. Understanding what a fact in issue is, is critical as facts associated with elements of a crime or pleading form the basis of an offensive or defensive strategy. Section 55(1) of the Evidence Act gives one some hints - [ 272 more words ] http://jurisnguyen.com/2020/07/17/what-is-a-fact-in-issue/
