The ALRC has been asked to undertake a review of the laws relating to impartiality and bias as they apply to the federal judiciary. ... Any person before a court has the fundamental right to a hearing by a judge who is independent and impartial. In Australia, judicial independence and impartiality are seen as fundamental to the common law system of adversarial trial, to the exercise of judicial power under the Australian Constitution, and to upholding public confidence in the administration of justice. Ensuring impartiality also promotes the important values of treating parties to litigation with equal respect and dignity. Tied to this, the rule against bias is one of the two pillars of natural justice. Australian courts have long recognised that [t]he public is entitled to expect that issues determined by judges and other public office holders should be decided, among other things, free of prejudice and without bias. In Australia, including in relation to the federal judiciary, the law on bias is predominantly found in common law. Two different types of bias may be alleged: actual or apprehended, reflecting the imperative that justice must both be done, and be seen to be done. A claim of actual bias requires proof that a decision-maker in fact approached the issues with a closed mind or had prejudged them such that he or she was so committed to a particular outcome that he or she will not alter that outcome, regardless of what evidence or arguments are presented. On the other hand, the test for apprehended bias considers whether, in all the circumstances, a fair-minded lay observer with knowledge of the objective facts might entertain a reasonable apprehension that the judge might not bring an impartial and unprejudiced mind to the resolution of the question. 11.01.2022 The Australian Academy of Science and the Australian Academy of Law jointly sponsored a symposium on the reception, quality and evaluation of scientific evidence in Australian courts during National Science Week. The online event was moderated by the Hon Justice Virginia Bell AC, Judge of the High Court of Australia, and drew an estimated audience of around 600 (there was lots of justiceinjustice advocates attending that's for sure !). Minute 42.50 is Professor Carola Vinues...a FAA, Professor of Immunology and Co-Director, Centre for Personalised Immunology, Australian National University's speech on Kath re the teams CALM2 mutations & issues in relation to presenting compelling scientific material as evidence in courts of law here in Australia. There was well over 4 million points of contact with various broad reaching media stories that followed after Quentin McDermott's exclusive with Professor Carola Garcia De Vinuesa et al broke the night of her courageous & determined presentation re the teams findings. I think that shows just how much interest there is in #justiceforkathleenfolbigg , the case overall and the broader issue of how we assess & weigh scientific evidence in the Australian legal system. Abstract: Aims In 2003, an Australian woman was convicted by a jury of smothering and killing her four children over a 10-year period. Each child died suddenly and unexpectedly during a sleep period, at ages ranging from 19 days to 18 months. In 2019 we were asked to investigate if a genetic cause could explain the deaths, as part of an inquiry into the mother’s convictions. Methods and results: Whole genomes or exomes of the mother and her four children were sequenced. Functional analysis of a novel CALM2 variant was performed by measuring Ca2+-binding affinity, interaction with calcium channels and channel function. We found two children had a novel calmodulin variant (CALM2 G114R) that was inherited maternally. Three genes (CALM1-3) encode identical calmodulin proteins. A variant in the corresponding residue of CALM3 (G114W) was recently reported in a child who died suddenly at age 4 and a sibling who suffered a cardiac arrest at age 5. We show that CALM2 G114R impairs calmodulin's ability to bind calcium and regulate two pivotal calcium channels (CaV1.2 and RyR2) involved in cardiac excitation contraction coupling. The deleterious effects of G114R are similar to those produced by G114W and N98S, which are considered arrhythmogenic and cause sudden cardiac death in children. Conclusion: A novel functional calmodulin variant (G114R) predicted to cause idiopathic ventricular fibrillation, catecholaminergic polymorphic ventricular tachycardia, or mild long QT syndrome was present in two children. A fatal arrhythmic event may have been triggered by their intercurrent infections.
