22.01.2022 Conveyancing Tip: When you are buying property subject to existing tenancy and you intended to move into the property few weeks after settlement than you are required to give 60 days notice to the tenants for them to vacate the property. Alternative to this is to buy the property as a vacant possession and request the vendor to give notice to the tenants. Vendor is only required to give 30 days notice.

21.01.2022 Conveyancing Tip: If you are buying off the plan than you should be aware that the settlement could take quite a long time and any formal loan approval becomes invalid after few months. Normally under off the plan contract you are required to if certain documents are served and it would be highly recommended that you negotiate to have at least 4 weeks or 28 days for settlement and always follow up with your broker.

We recommend that you lodge a caveat as soon the the contract become unconditional to protect your interest.

05.01.2022 Free legal help for flood victims [PDF, 139kb] Issued: Wednesday, 8 February 2012 The NSW Attorney General, Greg Smith SC, today reminded flood-affected residents across NSW that they can get free legal help with their insurance claims.... Mr Smith urged these people to contact LawAccess NSW on 1300 888 529 or the closest Legal Aid NSW office in Dubbo (6885 4233) or Lismore (6621 2082). This is a dreadful situation for residents in regional NSW whose homes and property are being damaged in the floods, Mr Smith said. Anyone who needs help to understand their insurance policy or to make an insurance claim should take advantage of free legal information and advice." Flood victims are advised to take these steps: Keep a record of flood damage - take photos and videos where possible. Ask neighbours to witness the damage. Carefully check the wording of their insurance policy and, if in doubt, obtain legal advice before speaking to claims assessors, who usually visit on site. Make sure that premiums have been paid in full, or are up to date, before lodging any claim because premium shortfalls may affect payment. "Even if your policy does exclude flood it would likely cover other water-related damage such as rain and storms. These can be difficult legal issues and I urge residents if they have doubts about their policies to get free legal advice," Mr Smith said. Legal Aid NSW lawyers can provide free advice and assistance with: insurance claims; renegotiating credit commitments due to loss of income from the flood; and issues for tenants where the property is seriously damaged from the flood. 04.01.2022 First Home Plus stamp duty exemption legislation has been amended and from 1 January 2012 the stamp duty exemption or concession will only be available on purchase of a "NEW HOME". Under the act "New Home" means a home that has not been previously occupied or sold as a place of residence, and includes a substantially renovated home. where substantially renovated home means a home that:... (a) is new residential premises within the meaning of section 40-75 (1) (b) of the A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth, and (b) as renovated, has not been previously occupied or sold as a place of residence.

02.01.2022 Important amendment regarding witnessing of Statutory Declaration and Affidavits. Schedule 2 of the Identification Legislation Amendment Act 2011 inserts a new section 34 and 35 into the Oaths Act 1900. These new sections which commence on 30 April 2012 and require an authorised witness to take prescribed steps to identify a person making a statutory declaration or affidavit and certify that those steps have been taken. The prescribed steps are set out in the Oaths Regulation 2011 which also commences on 30 April 2012
