Real Estate is Open for Business Dear Members, We are extremely pleased to advise that the Premier has announced that private inspections can resume in Melbourne. The REIV was informed earlier today by the Minister of Consumer Affairs that private inspections for residential property will be permitted from 11:59 pm Sunday 27th September 2020. The details are not yet available but we have been assured by the Minister's Chief of Staff that we will be advised as soon as possible. Please wait for further clarification and detail before you plan your next steps. We need to make sure that any easing of restrictions is handled in a safe manner. This has been a great example of the industry coming together and supporting their representative body to communicate as one. 15.01.2022 THE BALLAD OF HARRY by Ray Heathcote A shopkeeper from Berwick Town; Harry was his name. Every day from 9 till 5, selling Menswear was his game. Harry’s was th...e greatest place to purchase shirts and jeans For fifteen years through good and bad - that’s how he made his means. One fateful day Dan Andrews said: I must close you down. I have to stop this virus now it cannot get around. I’ll let you re-open when things are safe again, Sometime in the future but I cannot tell you when. So, Harry did as he was told, thinking he’d be fine Using click & collect - with orders all online. He advertised far and wide, left no stone unturned But sales dropped off dramatically and he became concerned. Like many other traders then his business took a dive And for many weeks his little shop it struggled to survive. It wasn’t just the lack of sales that hurt and dragged him down. That old black dog soon appeared and started hanging round. So, Harry thought he’d go for broke with nothing left to lose. The word soon spread far and wide. It even hit the news: On Facebook, Instagram and more the ‘likes’ were on the rise. Harry’s shop was open again with clothes of every size. The men in blue then paid a visit, with a message to convey: Shut it down or risk a fine: ten thousand bucks you’ll pay. But the shop was full of customers. They all said: Dan’s to blame! Change the rules! Set us free! Our state let us reclaim! The cops came back again and again and sat and watched all day. They issued two enormous fines. They would not go away. They said we have no choice, of course, we hope you understand But the public support grew and grew. It was surely something grand. The orders kept on growing; more customers were found. Harry took on more staff; his business did rebound. With demand increasing day by day, especially online, It was time to make a change as things became benign. Sales were going through the roof from people on devices. Harry could not keep up; his shop had hit a crisis So, he closed the doors again, went back to click & collect And both fines were then withdrawn - a win, win I suspect. See more

We are incredibly disappointed with the government's announcements today that do not allow for inspections or new listings till the third step, earliest date being 26 October 2020. After multiple and ongoing attempts to work with the government in defining a reasonable path for the sector, the Andrews government has chosen to ignore the plight of property owners and the real estate sector. As such, we now call upon Members to refuse to negotiate rent reductions, forcing every request into the dispute system, a system that has already failed to cope with the caseload. We know that about three quarters of reduced rent agreements have been achieved amicably due to the cooperation of the real estate professionals and property owners. 13.01.2022 Update from the REIV Update on Property Appraisals in Metro Melbourne Dear Members,... During our discussions with government we sought clarification on residential property appraisals as this activity was not outlined in any of the Directions. The REIV proposed that property appraisals should be considered a necessary activity for the purpose of marketing or creating an interest in the property under the definition of dealing in residential property. As advised, we are in ongoing discussions with government to help all Members return to work in the most effective and safe manner possible in the current environment. After multiple engagements, we have now received written clarification that residential property appraisals can be conducted. Please refer to the details below. RESIDENTIAL PROPERTY - MELBOURNE METRO Can an agent and vendor/lessor conduct a private inspection for a property appraisal for the purposes of listing the property for sale/lease? Yes, private inspections for property appraisals prior to listing a property for sale or lease are allowed. Undertaking a property appraisal could be considered access to the property for the purposes of marketing under clause 7(13)(b) of the RAD (RA), as the estate agent would undertake this inspection to be able to market the property accurately including in relation to the price of the property. One person can attend the property in addition to the estate agent. All requirements listed in clause 7(14) of the RAD (RA) must be complied with. Can private inspections be conducted for property appraisals for the purpose of family law settlements? Private inspections for property appraisals for the purposes of family law settlements are permitted in most circumstances. If a court has ordered an appraisal to take place, or it is otherwise required by law or for purposes relating to the administration of justice, then an appraisal for the purposes of a family law settlement is permitted. If there is no legal requirement to undertake a property appraisal for the purposes of a family law settlement, but the property is going to be sold or leased, then appraisals are permitted for the purposes of marketing a house for sale/lease. If there is no legal requirement to undertake a property appraisal for the purposes of a family law settlement, and the property is not going to be sold or leased, then undertaking a property appraisal is not permitted.
