19.01.2022 When the money runs out! What happens if at the end, you accidentally spend more money than is in your NDIS plan? If your plan is Agency Managed, there should n...ever be an overspend, because you will have service bookings (not service agreements) on the NDIS portal which can never add up to more than the dollar amount in your NDIS plan. If you use providers who are not Agency registered, or you ask for service without a service booking in place first, YOU will be responsible for all of the bill. If your plan is Self or Plan Managed, there is nothing that prevents you from overspending, and if you do run out of NDIS plan funds, you will be responsible for paying any extra bills. While your Plan Manager can (and should!) help you keep track of your NDIS budgets, they're not responsible if you overspend, so you'll need to track your spending carefully. Also, be aware that many providers do not bill in a timely manner, and some Plan Managers do not pay in a timely manner, so your budget levels as listed with the Plan Manager might NOT be all that accurate. There are a few ways to help you stay "safe" from overspending. 1. Always request a copy of the invoices from your provider yourself - never have them "just send to the Plan Manager". 2. If you are getting near to the end of your plan and you think you'll be "cutting it close", ask for up to date invoices from your providers a month before the plan ends. 3. At the beginning of your plan, if possible (and it won't always be), set aside 5-10% of your NDIS plan budgets as "emergency funds" to be used through the year if a crisis or awesome opportunity arises that means you need extra support for a period (if it's an ongoing situation, be sure to ask for a "Change of Circumstances" review). That way, you should have a buffer at the end of your plan in case you overspend a little, and you also have extra funds to use to stock up on consumables or low cost assistive technologies, or some extra support for trips out and about or whatever, in that final month of your plan. 16.12.2021 New NDIS Price Guide line items These are in place until 30 September, with a review by the end of June: COVID-19 Low Cost AT to support Capacity Building support delivery: This line item is to allow participants without access to a smart device to purchase one to the value of $750 to maintain their disability supports. They will need to provide the NDIA with written advice from their provider that the device is required and it will need to be to the lowest specification poss...ible to maintain the support. Unlike other low cost assistive technology line items, which are purchased from the Consumables budget, this item comes under Improved Daily Living. 2 new assistive technology rental line items to meet immediate (ie. 30 day) needs for people leaving hospital. Items for SIL providers in case of a COVID-19 diagnosis including a one-off professional deep cleaning fee of $300 and a $1,200 per day allowance to cover additional costs like staffing and PPE

21.10.2021 Just tell them to get an ABN! Oh my, I read this quite a bit on various Facebook groups and it always makes me a little nervous. Just because your neighbour/f...riend/ brother-in-law’s girlfriend seems fabulous to do your support work/gardening/cleaning does not mean that getting an ABN is the right or legal way to manage this, though it *may* be. As a participant/nominee, you need to do your homework - here's a start for you 1. ask for a police or appropriate clearance. 2. check if the person you want to use is legally considered a contractor (with ABN) or an employee. Just having an ABN does NOT mean they are not legally an employee you can use this tool to help figure it out - https://www.ato.gov.au/business/employee-or-contractor/ and check out the info at the Fair Work Ombudsman, too - https://www.fairwork.gov.au/find-he/independent-contractors 3. If the tool tells you that they are a contractor, then you’ll want to make sure they have appropriate insurances to protect you and them. 4. If the tool tells you they should be considered an employee, then you can either have them sign up with a provider as a worker, or self employ them which likely means workers comp insurance, appropriate award (or above) pay, tax stuff, superannuation etc. You’ll want to get actual advice on this. 5. If they are a genuine contractor (which, once again, is not proven by simply having an ABN) then you’ll want to ask for a certificate of currency to check they are insured. 6. If someone is doing a once-off bit of work for you, they may not need to be set up as a business (ABN) or an employee in this case you can withhold 47% for tax, or they may be eligible to give you a Statement by supplier https://www.ato.gov.au//MEI/downl/BUS38509n3346_5_2012.pdf or the form may not be required at all if the transaction meets various ATO requirements (check with an accountant or lawyer I am neither!) 7. It’s also important to note that getting an ABN is not legal for lots of people here’s the info you need - https://www.abr.gov.au/business-super-fun//abn-entitlement 8. FYI, for Self and Plan Managed participants, the NDIS does NOT require an ABN on invoices (for example when the supplier does not have an ABN), but it DOES require that the transaction be legal, and most Plan Managers will demand ABN's on invoices as part of their own business practise, which is, of course, their choice to make. OK, now, I’m no lawyer or accountant, and none of this is legal or accountancy advice, but hopefully it will get you thinking and looking for professional advice before making decisions that could seriously land you in the poo later.
