12.01.2022 It’s well past time the Courts are asked to weigh in on the legitimacy of some of the lockdown laws. When police can enter and search your house and ARREST you, just because you are encouraging people to a attend a peaceful protest, we have a problem. That’s not the justice system that I have dedicated my life to. Our courts have long held that imprisonment is a punishment of last resort, that our citizens have a right to peaceful protest and that our privacy can be invaded ...only under limited circumstances. That has now all been overruled by a government issuing Directions that have no scrutiny or transparency. 08.01.2022 I’m seeing lots of confusion about exemptions to the Stay at Home Direction, especially because today is a severe fire rating day. The Direction sets out some circumstances when you can leave home, including: - in an emergency - when the fire rating for the day is severe or higher (but you must travel to another suitable premises by the most direct and practicable route) - to comply with legal requirements such as going to court or a bail reporting condition. ... 04.01.2022 Horseplay or sexual assault? It’s all about consent. If the person being grabbed says that they consented to being touched on the genitals, then it’s not an assault. If, however, they did not consent, then it is a sexual assault. It doesn’t matter whether this behaviour is part of a culture. It’s no defence to say well he did it to me once or he didn’t complain last time I did it. Whether touching is sexual depends on a few things: Whether the area touched is the ...person’s genital area (including anus and breasts), or Whether the area touched is not a genital area but is done for a sexual purpose. The touching of these footy players on their genitals is clearly sexual. The claim of there was no sexual intent is irrelevant. The fact it was through clothes is irrelevant. If there is even the slightest penetration without consent, even through clothes, it is rape. Whether it is horseplay or sexual assault is entirely up to the person on the receiving end. Seems like very dangerous and risky "joke" to me. Arguably, even with consent, it amounts to "indecent behaviour" because it is done where the players know there are cameras. 03.01.2022 Stanley Law is four years old today. When I first started out, I thought I’d be doing mostly wills and estates. Never in my wildest dreams did I think I could have a busy and successful practice doing what I love; criminal and traffic law. To all my clients who put their faith in me when I said I have an argument. It’s never been run before, and I think you will probably get convicted and we will end up in the Supreme Court, but I think it’s a great argument: thank you. It’s a massive thing to put your trust in a lawyer, especially when that lawyer is running a completely untested argument. And geez, we’ve done some stuff! I can’t wait to see what we can do in the next four years.
