25.01.2022 Corrective Services officers and other staff members can easily exceed their duties and powers when disciplining inmates. But they sometimes take it too far. Two former gaol employees and their supervisor face misdemeanour cruelty charges after investigators found they forced inmates to stand handcuffed for hours and listen to the children’s song Baby Shark on repeat.
25.01.2022 Congratulations to these ladies with brilliant legal minds who have been appointed as Magistrates for NSW Local Courts

Whether an imitation or toy firearm falls within the statutory definition of a firearm or weapon for the purpose of an offence under the Firearms Act 1996 is determined by reference to the use and intention of the accused at the time of possessing the imitation firearm or toy. This was recently explored in the case of Darestani v R [2019] NSWCCA 248. For more information about the above an...d the basic elements of firearms offences, please visit our web page below. https://www.kflawyers.com.au/firearms-prohibited-weapons

18.01.2022 Fundamental to the bail process is the presumption of innocence, the right to be at liberty and procedural fairness. The presumption of innocence and the right to liberty are two important principles of our common law underpinning the Criminal Justice System. Bail can be refused where there do not appear to be any bail conditions which could address the concerns for the safety of the community nor other risks of the accused were to be released on bail. Today we appeared in the Supreme Court of NSW for a show cause bail application on behalf of a man accused of two counts of perverting the course of justice. Thanks to our learned Counsel Hament Dhanji SC, our client was success and he can soon expect to be released from custody!
