20.01.2022 See that grave look on Kate's face? That is the look she will give you if you tell her you've spoken to the police. Please do NOT participate in a police interview. Interviews are designed to pull admissions from you and damage your ability to successfully defend your charges in court.... Contact us before answering any police questions!

17.01.2022 What's better than winning your case? Winning your case with costs! Winning with costs means that in addition to being found not guilty of your criminal charges, the police will be required to pay a significant portion of your legal fees (talk about satisfying)! Needless to say, we are always excited to receive letters like the one shown here. This particular client of ours was found not guilty of contravening a family violence order in October and his costs order arriv...ed this month. The ACT Magistrates Court is a particularly generous jurisdiction when it comes to costs in criminal matters. Please get in touch with us if you want to know more. #lawyers #criminallaw #criminallawyers

16.01.2022 We thought we'd have some Friday afternoon fun with this meme But in all seriousness - please be aware, if you give incriminating instructions to your lawyer, we become severely hamstrung in the way we can defend you. For example, if you tell us you were present at an alleged incident, we cannot then mislead the court by adducing alibi evidence. We can, however, require the prosecution to prove it is you in the footage. (This will involve maintaining a poker face much bett...er than the one below while the CCTV footage is played). Because of this, most criminal lawyers will not ask for your instructions on certain issues. For example, if the CCTV footage is sufficiently ambiguous, we will not give you the opportunity to incriminate yourself by asking: "is this you?" Happy Friday everyone!

15.01.2022 KG Criminal Law is passionate about promoting a healthy work life balance. Pilates Can helps Kate achieve that balance (though heels are not usually recommended). That being said - have a good long weekend everyone, enjoy the time off and the sunshine!

11.01.2022 "Boys will be boys" - it's a popular saying but even this age-old expression may not be enough to excuse recent behaviors. Kate Gunther discusses the potential offences arising from the latest private school scandal in Sydney: https://www.kgcrimlaw.com.au/high-school-boys-criminal-cond

10.01.2022 Despite the photo, there hasn't been much time for Christmas parties this festive season as Kate was instructing in an ACT Supreme Court trial for most of December while also appearing for various matters in the ACT Magistrates Court. The ACT Supreme Court trial ended with the jury finding our client NOT GUILTY of all charges. Needless to say he was very happy heading into the Christmas season (and so are we)!... We look forward to more trials in the new year and wish everyone a fun-filled Christmas break! Though our office will be closed until the 4th of January 2021, Kate is available to give urgent advice and appear in Court during the shutdown period. Please call her on 0414 255 705 if you need.

04.01.2022 Why do you defend "criminals"? How do you sleep at night? These are common questions faced by a defence lawyer but the answer is simple: Because the world is not so black and white and people are not simply all good or all bad. There must be a means to challenge the authorities and ensure they are subject to the rule of law.... The shocking video in the below link of a police officer assaulting an indigenous man is a perfect example of this reality: https://www.abc.net.au//footage-shows-police-off/12797886

02.01.2022 Kate had the pleasure of writing for the ACT Bar Bulletin this month about her journey from an employee in law to the sole Director of her own firm. See where her journey began in the photo below (a fresh-faced graduate) and where she is now in the article link: https://mailchi.mp/actbar/bar-bulletin-december-7214889 We would like to thank all our clients for taking this journey with us. It has been, and is, wonderful representing you. We look forward to continuing to assist in all things Criminal Law!

01.01.2022 KG Criminal Law has been spending a lot of time in the ACT Supreme Court lately - this week as the instructing solicitors in a trial. The ACT courts are just one of the stunning locations we are lucky enough to attend regularly. Another is the classic-style court house in Goulburn, NSW What do you like best - The modern marble in ACT or the classic courthouses in regional NSW?
