24.01.2022 CASE REPORT Majed (Jr) appeared at Bankstown Local Court today with Mahmud Hawila of counsel in hearing wherein our client was charged with affray pursuant to s93C of the Crimes Act 1900 (NSW). Our client was charged after a woman and staff members at Bass Hill Plaza were being abused by 2 men; our client came to the aid of these innocent victims resulting in a violent brawl where he was attacked by the men. An argument of self-defence was raised at the outset of the hearin...g in accordance with s418 of the Crimes Act 1900 (NSW). Prosecution witnesses were called and following the conclusion of the prosecution case, Mr Hawila made the submission that the Police had failed to establish a prima facie case and the matter should be dismissed without the need to hear Defence evidence (May v O'Sullivan (1955) 92 CLR 654). The Magistrate agreed with this submission and thus moved to dismissing the charge and finding our client not guilty. Ultimately, the matter was a great result for all involved as the Court determined that our client's actions by intervening to protect innocent and defenceless civilians should not be condemned but rather, an individual's right to defend themselves or those around them should be upheld. 23.01.2022 A routine mitigation plea for a traffic offence at Bankstown Local Court by Majed Kheir ! Another great result obtained this week at Kheir Lawyers for a client who approached us having sustained a 6-month suspension for a driving offence. Unfortunately for the client, he had just purchased a brand-new gorgeous Mercedes A250 and, given the suspension, would have been prevented from enjoying his motoring masterpiece for 6 agonising months. The matter was further complicated by ...two factors: 1. The client was a P2 provisional license holder and thus incurred additional demerit points for his driving offence 2. The client had previously been issued a license suspension whole on his P1 provisional license After referring the client to a Traffic Offenders Rehabilitation Program (TORP) from one of our extensive network of providers, submissions were made by Majed Kheir (Jnr) of our office for a mitigation of the sentence given a number of factors including the undertaking of a TORP, the impact of the suspension on the clients career and studies and the clients remorse. The presiding magistrate reduced the clients suspension from 6 months to just 4 weeks (given the clients poor driving record). Not quite the perfect outcome, but nonetheless a happy client who only has to wait a few short works to return to his beautiful beast of a car rather than 6 months ;) . 22.01.2022 As reported earlier this week, despite the confusing and chaotic times we find ourselves in, Kheir Lawyers remains hard at work to satisfy and attend to our communitys legal needs. It has been a big week at Kheir Lawyers for our personal injury department with three seperate matters settled this week obtaining settlements and damages totalling in excess of $1.5million for our clients. In one matter, Kheir Lawyers took over a claim from another firm wherein the client was ad...vised by his previous solicitor that his claim was worth approximately $150,000. We are happy to report that pursuant to our advice the matter was referred to arbitration and an award was obtained on behalf of our client in excess of $350,000. 20.01.2022 CASE REPORTS An incredibly busy but fruitful day on the Local Court Circuit for Kheir Lawyers today with two great results achieved for clients at two seperate courts. Majed Kheir (Jnr) attended Bankstown Local Court first thing this morning where he successfully appealed against the RMS suspension of his clients license. The suspension was quashed by the court despite the client having been travelling at 19 kmph over the speed limit AND doing so on the Queens Birthday publ...ic holiday thus carrying double demerits. Following submissions on the clients requirement to carry a license being employed by a real estate agency and his good prospects of rehabilitation, the court found him to be a fit and proper person to carry a license and unconditionally upheld his appeal. Following this, Majed rushed to Liverpool Local Court where, together with counsel, he was part heard in a matter in which our client was charged with significant domestic violence offences including common assault pursuant to section 61 of the Crimes Act 1900. Following extensive cross-examination of both the alleged victim and defendant, the Magistrate found there to be insufficient evidence to uphold a conviction and thus dismissed all charges against our client and finding him not guilty on all counts. Overall, a tiring but successful day which saw good results achieved for our clients who were exceedingly pleased with the results. 18.01.2022 CASE REPORT As life as we know it continues to change radically every day, the work does not stop here at Kheir Lawyers, and our dedication to clients remains unwavering. While Local, District and Supreme Courts are closed to the public for almost all matters, today Kheir Lawyers appeared at Liverpool Local Court for the hearing of a bail application on behalf of a client who was charged with 9 offences relating to possession of firearms, ammunition and other related offences.... Majed Kheir (Jr) appeared alongside counsel in making submissions that after the recent confirmation of at least one case of COVID-19 at Long Bay Correctional Facility where the client was held and the significant delays that will arise in listing the trial given the closure of courts and backlog of matters, that it would be reasonable for the release of the Defendant until trial. These submissions were accepted by the Magistrate who granted bail with the client to be released later today, despite bail being opposed by the prosecutor. 16.01.2022 Following over 12 months of anticipation, we are very excited to announce that our new premises at 45 Stanley Street Bankstown is FINALLY up and running and we have completed our move from our former premises at Bankstown Civic Tower. 15.01.2022 CASE REPORT A busy couple of weeks has seen Kheir Lawyers obtain some great results for clients in criminal proceedings. Last week at Bankstown Local Court Kheir Lawyers Majed Kheir (Jr.) represented a Defendant charged with the federal offence of using a carriage service to threaten to kill pursuant to s. 474.15 of the Criminal Code Act 1995 (Cth). ... After obtaining an expert report from the Defendants treating specialist, Kheir Lawyers successfully made an application in accordance with s. 20BA of the Crimes Act 1914 (Cth) outlining that the Defendant was suffering from a significant mental illness at the time of committing the alleged offence. Thus, the charge against the Defendant was dismissed. On the very same day, Kheir Lawyers, once again via Majed Kheir (Jr.), attended Burwood Local Court for the sentencing of an offender who had been initially charged with the offence of robbery in company pursuant to s97(1) of the Crimes Act 1900; a charge which carries a maximum sentence of 20 years imprisonment. After extensive negotiations with the DPP, Kheir Lawyers were able to have this charge withdrawn and replaced with a charge of intimidation or annoyance pursuant to s545B of the Crimes Act 1900; a charge which carries a maximum sentence of 2 years imprisonment. After substantial submissions to the Court by Kheir Lawyers, the Defendant was sentenced to a Community Corrections Order (CCO) with a condition to be of good behaviour. 14.01.2022 ANOTHER SUCCESSFUL DAY ON THE LOCAL COURT CIRCUIT featuring Majed Kheir ! Kheir Lawyers ran an interesting matter today on behalf of a client charged with stalking or intimidation with intent to cause fear of physical or mental harm pursuant to section 13 of the Crimes (Personal and Domestic Violence) Act 2007. The client was charged after sending a series of voice messages to an individual who was at the time residing in Lebanon via the carrier service WhatsApp. A number... of key issues arose in this matter including: 1. If the element of fear was relevant to alleged victims residing thousands of kilometres away with no serious chance of following through on any threats 2. The client, prior to instructing Kheir Lawyers, participated in an Electronically Recorded Interview of a Suspected Person (ERISP) wherein he had made admissions as to conduct with which he was charged. 3. The client works as a full-time security guard. Pursuant to s16 of the Security Licences Act 1977, the client would be denied renewal of his license if he had a criminal conviction within 10 years prior to application for renewal. The result was a resounding success with Kheir Lawyers submissions outlining that the Defendants conduct was towards the lower end of the spectrum and that any conviction would preclude the Defendant from continuing his work which was the only source of income with which he could provide for his family. Ultimately, the presiding magistrate recorded NO CONVICTION with a 2-year good behaviour bond. The client will be able to continue his work in the security industry thanks to the work and submissions of Majed Junior and Mr Derek Drewett as counsel. One key takeaway from this case is if you are ever confronted with a situation wherein police have asked you to participate in an ERISP you should ALWAYS exercise your right NOT TO until you have obtained proper legal advice/representation. 13.01.2022 CASE REPORT Kheir Lawyers, via Majed Kheir (Jnr) and Derek Drewett of counsel, appeared at Parramatta District Court today where an appeal was heard from the Childrens Court of Parramatta regarding the conviction and sentence of a 15-year old male on charges of kidnapping and assault. Following his sentence in February 2020, our client was advised that he would be required to Register on the Childrens Protection Register despite being a minor himself. ... An appeal was filed seeking that the conviction be dismissed and instead dealt with by way of a non-conviction good behaviour bond pursuant to s33(1)(a) of the Children (Criminal Proceedings) Act 1987 (NSW). Following extensive submissions by Kheir Lawyers regarding the parliamentary commentary and purpose of the relevant Act and opposing submissions being made by the Office of the Director of Public Prosecutions, her Honour Justice Herbert saw fit to allow the appeal and withdraw the conviction on the charge of kidnap/detain with intent to commit serious indictable offence. This variation in sentence had the effect of withdrawing our client from the Childrens Protection Register, thus allowing the young man to continue his studies and other extra-curricular activities unencumbered by the onerous requirements of the Childrens Protection Register. A great result for the Appellant who will hopefully comply with the conditions of his bond and go on to become a significant positive contributor to our local community. 09.01.2022 CASE REPORT Kheir Lawyers Majed Kheir (Jnr) attended Newtown Local Court earlier today, appearing in a matter in which the client was charged with offences relating to possession of a prohibited drug. After submitting a guilty plea at the earliest available opportunity, extensive submissions were made on behalf of the client regarding the relatively low scale of offending involved, the impact of a conviction on the clients career prospects as an electrical engineer and th...e clients strong prospects of rehabilitation and low risk of reoffending. Despite the client having an extensive criminal record, the strength of Kheir Lawyers submissions was such that the client was only sentenced to payment of a $200.00 fine. A great result for the Defendant who will hopefully repay the faith of the court and avoid any future offending. 09.01.2022 Updates on Kheir Lawyers operation amidst coronavirus outbreak and containment. Kheir Lawyers have considered the health situation posed by the Corona Virus issue and upper-most is our concern for the health and safety of our clients and staff. We have decided that we will suspend all non-essential contact with clients for the next 2 weeks and we will review the situation as more information becomes available.... 06.01.2022 LEGAL UPDATE Following on from last weeks post on the National Cabinets Mandatory Code of Conduct for commercial tenancies, further reform has now been introduced to residential tenancies in the form of the NSW State Governments Residential Tenancies Amendment (COVID-19) Regulation 2020. If you are a landlord or tenant subject to a residential tenancy agreement you MUST be aware of your rights and responsibilities arising out of the Regulation. ... Essentially, the Regulation imposes a mandatory moratorium period of 6 months on all evictions of tenants who have been financially impacted by COVID-19 and the ensuing lockdown laws. Evictions now may only be imposed when: 1. A tenant is unable to demonstrate that they have been impacted by COVID-19. NOTE: The threshold of proof for demonstrating financial disadvantage from COVID-19 is relatively low (i.e. a tenant may provide proof of job termination, temporary stand-down, reduction of hours or pay, proof of Government income support such as JobSeeker etc.) 2. 05.01.2022 Drivers beware! Following a six-month pilot program which saw the roll-out of mobile phone detection software accross the state, the NSW Government has indicated that plans are in place to make the software a permanent and enforceable fixture on NSW roads. Acusensus, the company charged with the task of developing and implementing the software, reported that over 165,000 NSW drivers were caught by the software during the pilot period. If the NSW Government were to authorise... and enforce the use of such software it would be an unprecedented move in road safety laws and the first jurisdiction in the WORLD to implement such software. 04.01.2022 Majed Kheir (Jr) appeared on behalf of Kheir Lawyers this morning alongside Mahmud Hawila of counsel at Bankstown Local Court representing a client charged with numerous serious offences. Kheir Lawyers were instructed to apply for bail for our client who had been in custody for some 3 months. Our client was charged with the following offences: 1. Unlawful entry on inclosed lands ... 2. Drive whilst suspended 3. Armed with intent to commit serious indictable offence 4. Assault police officer 5. Resist arrest An additional charge of place explosive on/near public place with intent to cause harm was earlier withdrawn following discussions with prosecutors. Our client also had a significant criminal record which included prior offences of failing to appear, breaching bail and executed arrest warrants. In addition, the offences with which he is currently charged were committed while at conditional liberty on a previously imposed Intensive Corrections Order (ICO) with a bond. The client had made full admissions to Police during his interview and chose to plead guilty. 02.01.2022 LEGAL DEVELOPMENT In light of the ongoing COVID-19 pandemic, the NSW State Government has today announced the Public Health (COVID-19 Restrictions on Gathering and Movement) Order 2020 [NSW] which unveiled a host of new sweeping powers granted to law enforcement agencies to uphold social distancing and isolation protocols including fines of up to $11,000 and imprisonment periods. Below is a list of "reasonable excuses" for the purposes of the Order which outlines the circums...tances under which individuals can travel together with a list of "essential gatherings" which outlines the very limited instances in which 2 or more people may be gathered in a public place. Kheir Lawyers urges the community to adhere to these orders in order to aid the efforts to slow the spread of this virus and to also to avoid unnecessary legal action including pecuniary penalties and potential custodial sentences. However, while Kheir Lawyers appreciate the severity of the current circumstances, the community should be wary of the extent to which civil liberties and ordinary rights are surrendered in this time of crisis. 01.01.2022 CASE REPORT Last week, Majed Kheir (Jnr) appeared at Bankstown Local Court on behalf of a female charged with contravening an apprehended violence order (AVO) pursuant to section 14 of the Crimes (Domestic and Personal Violence) Act 2007. Our client was an individual suffering from numerous, severe mental health disorders which significantly contributed to her offending behaviour. Accordingly, Kheir Lawyers lodged an application in accordance with section 32 of the Mental He...alth (Forensic Provisions) Act 1990 seeking that our client be dealt with in a manner reflective of her psychological disabilities to allow her to continue treatment with medical specialists without the difficulties of a criminal conviction and sentence. Following extensive legal submissions and expert medical evidence, our application was accepted and our client was ordered to attend psychiatric treatment for a period of 6 months. No conviction or sentence was imposed for her offence. Ultimately, a just outcome was achieved for all parties with the community's expectations satisfied as to how individuals suffering from mental illnesses should be treated.
