23.01.2022 Our client today was sentenced to an Intensive Corrections Order for her part in the supply of 8.64 grams of Cocaine and having more than $17,000 in cash being the proceeds of crime. The sentence meant that she would not be going to prison but rather serving her prison sentence in the community. Another great result for a client who had experienced much trauma in her life which led her to be manipulated into dealing drugs as part of the well documented dial a drug dealer syndicates.



20.01.2022 This week Kiki Kyriacou appeared for two clients who were charged with different offences, however each received s.10 bonds. This meant whilst in each case the offence was proven, the court proceeded without recording a conviction upon each client entering into a good behaviour bond to be of good behaviour. Also in another matter a client received a section 10 dismissal. The first case involved a client who was issued a penalty notice for driving with cocaine present in hi...s oral fluid. The matter was brought before a court and the client was spared having his driving privileges disqualified for 3 months. As a professional truck driver this was a very much needed result for he and his family. The second case involved a man in his late 60 having verbally abuse another male and threatening to shoot and kill the man as a dispute arose over the purchase of a brand new boat. Whilst the client had a previous conviction on his record and had also been afforded the benefit of a section 10 dismissal, Mr Kyriacou submitted to the Court that due to the unusual circumstances of the case, his client was worthy of leniency for a further time. The third case involved a young male who had called his ex girlfriend over 100 times in the early hours of the morning. Whilst he was charged with stalk/intimidate intending to cause fear, the client was spared a criminal conviction and left Court with his clean record intact. See more

19.01.2022 KK Lawyers welcomes newly appointed solicitor, Patrick OSullivan to the team. In his first matter instructing Tom Warr of counsel in an 8 week District Court trial, his commitment and hard work has resulted in well deserved verdicts of acquittal for our client who was charged with kidnap and extortion and an aggravated break and enter. Our client had spent over two years on remand awaiting trial and now has a bright future to look forward to. It could also be said that the defence raised at trial led to the acquittals on the same charge for two other co-accused.

17.01.2022 A very satisfying result for our client today in court. Facing 8 charges of differing violence offences, which carried maximum penalties of imprisonments ranging from 2 to 10 years, not only had the charges withdrawn against him but was successful in seeking an order for costs as claimed. Slade Howell of counsel was briefed instructed by Kiki Kyriacou. Mr Howell argued against an adjournment and then successfully kept the complainants DVEC from being admitted into evidence.

11.01.2022 One of the most difficult matters Ive had for some time, a young uni student, with a bright future ahead of him is asked by his mate to help out unpacking boxes and then finds himself charged with attempting to possess almost 500 kilograms of the drug, methamphetamine. His criminal involvement was approximately 1 1/2 hours. He had only become aware of the true nature of what he was doing during the unpacking stage, at some 20 minutes into it. Through hard work and seeking nu...merous concessions from the CDPP the client received a sentence which at first seemed impossible having but regard to comparative cases of this kind. The client was realistically looking at serving anywhere between 8-14 years minimum in gaol. The client was sentenced in June 19 to a minimum term of 5 years. A special thanks to counsel, Avni Djemal for his exceptional submissions on sentence, bringing into line the true nature of the clients offending notwithstanding the magnitude of the weight of the drug. 11.01.2022 Today Kiki Kyriacou appeared at the Downing Centre District Court to receive judgment for our client who was charged with possessing 98 kilograms of cocaine which was reasonably suspected of being imported. The offence carries a maximum penalty of life imprisonment. Following negotiations with CDPP on the facts and further submissions by counsel Bret Walker SC and Avni Djemal that his role in the enterprise was at the lower end of objective criminality, our client was sentenced to a term of 5 years imprisonment. 08.01.2022 Our client who was facing serious charges concerning the supply of cocaine in or around the Sydney metropolitan region, escaped a full time gaol sentence. 04.01.2022 Judgment Just In: The Court of Criminal Appeal has allowed an appeal against the sentence imposed on Mr Andary for the offences of knowingly take part in the manufacture of a prohibited drug and possess prohibited firearms. We successfully argued the following grounds of appeal: 1. The sentencing judge erred in his acceptance of a significant factor that the firearms were located in a house where a manufacturing enterprise was being undertaken; ... 2. The sentencing judge erred in holding the objective seriousness of the prohibited firearm offences as mid-range; 3. The sentencing judge erred in holding the applicants anxiety and depressive disorder did not warrant a reduction in sentence. The Court re-sentenced the applicant to a term of imprisonment of 3 years 3 months with a non-parole period of 2 years. Mr Andary will be eligible for parole from 4 October 2020. 01.01.2022 Another great effort by our newest member at KKLaw, Patrick OSullivan. Our client who was charged with supply prohibited drug of 130 grams of methylamphetamine and resist officer on a form 1, received a sentence of 18 months with a non parole period of 12 months to serve. Following the presentation of very detailed submissions, the Magistrate backdated the sentence, which meant that it was to be served wholly concurrent with an existing sentence the client is presently serving and expires in April 2019. This all means that our client is to serve a further 4 months for the supply charge. Hard work and a thorough understanding of sentencing principles always pays off. A job well done.
