25.01.2022 Gobsmacking!! ... indefinite detention without trial for questioning on the basis of a warrant which cannot be disclosed but which allows forcible arrest, search and seizure and can be issued orally and used against children as young as fourteen. Lawyers are optional at the questioners discretion.

25.01.2022 Theres law, and theres justice. Any resemblance between the two is purely coincidental. Read on.

25.01.2022 And for those wondering about human rights in the wake of the Bunnings encounter here is an extract from the Declaration of Human Rights:

24.01.2022 This problem infects many prosecutions.

23.01.2022 Look what I found! A good review.

23.01.2022 When I started my psychology degree at UNSW the Head of the Department was researching and doing just this sort of therapy. It was known as aversion therapy and involved showing men pictures of other men, with a device applied to the penis to measure arousal, which was then "punished" by electric shocks. Back then I dont know if there were any ethics committees, but, evidently, it must have passed scrutiny. It is now a crime.

23.01.2022 I know this feeling but would have called it something more basic.

23.01.2022 I’m glad I only do criminal law. The crossbow at the Bar Mitzvah was the icing on the cake. Read on.

21.01.2022 This relates to a judge who was "named and shamed" for his treatment of lawyers in court. Makes you wonder what was behind his courtroom behaviour, psychologically.

21.01.2022 I dont think this defence has much chance of success but the investigators certainly were creative.

21.01.2022 Should a child that believes in Santa Claus, the Easter Bunny and the tooth fairy be making life-altering decisions?

20.01.2022 -Lawyers should never ask a Texas grandma a question if they arent prepared for the answer. In a trial, a Texas small-town prosecuting attorney called his firs...t witness, a grandmotherly, elderly woman to the stand. He approached her and asked, Mrs. Jones, do you know me? She responded, Why, yes, I do know you, Mr. Williams. Ive known you since you were a boy, and frankly, youve been a big disappointment to me. You lie, you cheat on your wife, and you manipulate people and talk about them behind their backs. You think youre a big shot when you havent the brains to realize youll never amount to anything more than a two-bit paper pusher. Yes, I know you. The lawyer was stunned. Not knowing what else to do, he pointed across the room and asked, Mrs. Jones, do you know the defense attorney? She again replied, Why yes, I do. Ive known Mr. Bradley since he was a youngster, too. Hes lazy, bigoted, and he has a drinking problem. He cant build a normal relationship with anyone, and his law practice is one of the worst in the entire state. Not to mention he cheated on his wife with three different women. One of them was your wife. Yes, I know him. The defense attorney nearly died. The judge asked both counselors to approach the bench and, in a very quiet voice, said, If either of you idiots asks her if she knows me, Ill send you both to the electric chair.....

20.01.2022 I haven’t dared listen to my bit.

19.01.2022 Newspaper report: thoughts?

18.01.2022 WHEN will police trainers stop teaching their recruits a foreign language? Especially when they insist on speaking in that dialect on television. EXHIBIT I: Channel 7 News, police officer commenting on a stabbing: "she was exiting her vehicle as she attended a family residence". (I may have a couple of minor words wrong but the offending words are all correct.

17.01.2022 Answers for the anti mask nutters.

17.01.2022 ALWAYS read the fine print: here is an extract from a contents insurance policy I have to cover Airbnb guests in my home: "Loss or damage from impact by aerial, mast, flagpole, satellite dish, vehicle, watercraft, debris from space, aircraft, rockets, satellites, animals, trees or branches is covered only if caused by an act or omission of a guest or a guests visitor." WHAAAATTTT?

16.01.2022 Think before you post!

16.01.2022 The accused must have friends in high places!

16.01.2022 Sometimes there is not a lot of difference between family law and criminal law.

15.01.2022 The heads of all our courts comment on the harassment issue.

15.01.2022 I am delighted (if that is the right word) to be speaking on sexual harassment and bullying at the @Association of Corporate Counsel Australia’s In-House Legal Virtual Conference. I am supporting our global in-house community through speaking about this issue. If you’re an in-house lawyer, you need to be at this virtual conference this November! 14.01.2022 Perths legal and forensic community being so small, I know most of the people involved here.

14.01.2022 Is the offence of infanticide outdated and sexist? That law was repealed in WA in 2008, but is still the law in Victoria and NSW. Its based on the idea that women taking the lives of their children in their first year (or two in Victoria) were often in a disturbed state of mind due to childbirth. It was introduced in the UK when a conviction for murder resulted in hanging. It does NOT apply to men.

13.01.2022 Do you think you would be charged if you pulled this sort of stunt?

13.01.2022 So Kansas City is on track for another record year for murders. A police spokesperson said that one thing the people involved in these incidents have in common is ‘poor conflict resolution skills’. Thanks Captain Obvious! (Thanks to Annette Lee for her perspicacity).

12.01.2022 I wrote this some years ago. I think it's still true.

11.01.2022 Wow. Something really is changing.

08.01.2022 Here's what might happen if you appeal your sentence - so be careful.

07.01.2022 I am not surprised. This just underlines what I have said about the pointlessness of complaining. Then, but hopefully not into the future. The profession may just HAVE to take notice. Will we see redress actions next?

04.01.2022 This was 1938. I was not permitted to represent a client in 1989 by a judge for the same reason. The more things change the more they stay the same.

04.01.2022 Weakest excuse ever!

04.01.2022 I wrote this some years ago. I think its still true.

03.01.2022 A spot of humour for day 1 of lockdown.

02.01.2022 Mental health in lawyers, especially criminal lawyers. Hasn't been thought about nearly as much as it should have been.

02.01.2022 Gently suggesting (OK telling) a couple of clients this week not to answer questions reminded me of this.

01.01.2022 Zoom has a lot to answer for. So does this doctor.
