23.01.2022 Leasing During a Pandemic On 26 August 2020, the Supreme Court of NSW handed down its first decision in relation to the rent relief package provided by the Federal Government on 3 April 2020, in the case of Sneakerboy Retail Pty Ltd v Georges Properties Pty Ltd (No 2) [2020] NSWSC 1141. This decision enables tenants to rely on rent relief from 1 April 2020, rather than the Regulation commencement date of 24 April 2020. The decision goes on to further determine that a ‘tenant’s trade’ includes their turnover (incl. online sales), and is not limited to one specific site of operation but to all sites of operation. This is an important definition as a tenant’s trade’ assists both the tenant and landlord in the determination of rent relief. The regime aims to facilitate timely and efficient access to information by regulators and other users. All Directors, irrespective of their status will be required to hold a unique identifier which will remain in place even after they stop being a Director.
