23.01.2022 People need to know - an employer or partner CANNOT cancel your visa or have you deported! We hear this threat so many times and it can be terrifying to hear that your future is in somebody elses control but know this: Only the department of home affairs can cancel your visa and I have never had a client deported! Worst they can do is notify the department that the relationship (or employment) has ceased... You still have rights - like the right to comment on this information or the right to appeal a refusal or cancellation decision if you get the right advice before it gets to that stage there may even be other pathways to PR So often people are under the impression that partner visas are an easy way to PR. Those days are long gone, government fees are expensive and it can take years before you get PR. In some cases it may be the best option but it is not a quick fix by any means and if it all falls apart please remember this post - you have control over your future, nobody else and we will be here to help you put a strategy in place if you need it or just a chat to get your ducks in a row. We forget that with COVID many people are left here isolated, afraid to leave in case they cant get back and unable to have family over to visit. Since a number of Perth Migration Agents have had their registration cancelled we have received extensive enquiries in relation to fraudulent and unethical behaviour so we wanted to make this very clear: We do not assist applicants who fabricate work experience We do not assist companies who fabricate positions or who have a reputation for 'selling visas' or other adverse information... Most importantly we do not tolerate clients who lie to us (and yes - concealing or deviating from the truth is also a form of lying). There may be some misconception because of the unbelievable results we achieve but rest assured we achieve these outcomes because we know the legislation and policy inside out and fight for clients who place their trust in us and act with honesty. So please do not waste my time and yours - we have built an excellent relationship with Department of Home Affairs and integrity, honesty and ethics are our primary considerations. We will not be sacrificing this or my registration so you can take the lazy way out and most likely end up with a refusal or ban. There are plenty of other agents who will take your money and promise you the world. We are not a visa factory and don't give the cheapest price or easiest option - for the select clients we do assist we plan overall strategy to achieve outcome in the best way feasible. 21.01.2022 We have had lots of questions asking if certain work can count for the new working holiday visa announcement - particularly in aged care, pharmacy and different sectors of nursing and medical work. The department have now updated their website with of what may and may not count https://immi.homeaffairs.gov.au//work-holid/specified-work Remember the department website is a source of law and the legislation states including but not limited to the work listed - ...my interpretation is that this is very broad definition and open to argument!! While we can not give a yes or no answer - where the legislation is silent there is possibility and we have had some success with similiar wording in the subclass 408 (COVID stream) visa - there is never a guarantee and always a risk when a term is open to interpretation. We cannot give specific advice without conducting an assessment unique to your situation so if you do need further help please book in a phone consult and we will try to post GENERAL information here.

19.01.2022 Finally got the long awaited email for my own citizenship appointment After such a tough PR battle I put this on the long finger as I had just had enough..despite doing everyone elses Then we realised we needed citizenship approved to get the federal grant in time for our new house build so the pressure was on! Moral of the story do not be like Edwina and put things on the long finger. No matter how long you are in this country you are not secure until you have it and COVID has really brought that fact home. Now just to make sure I dont fail the test and know the national anthem

On the other hand, there seems to be significant delays with outbound travel exemption requests. My guess is we will soon see some new policy in this regard and in the interim we are pushing to move these applications to decision for our clients, who are often stuck in difficult circumstances I think this image of lady justice is so powerful and couldn't' be any more appropriate. We have started receiving general automated notices over the weekend for ALL applications lodged over the last 2 years. We will send specific instructions via email but at this stage please forward current evidence of relationship (4 pillars), book medicals (bupa is already booking up) and organise new police checks if current are over 12 months. 07.01.2022 This week we finished a long battle for PR and achieved our best outcome yet. This should have been impossible as usually you need to do a 482 visa on the labour agreement first. Our clients had already been in Australia for over 6 years and were messed around by their employer and thought they had lost their PR opportunity. We looked at things from a completely different perspective and assessed the applicant’s partner, who was told he had no options as a driver. ... The state government told us to withdraw our application as we would not get the 186 and to accept the 482 visa. Using our knowledge of contract law we found a way to argue for the 186 and the client agreed to take the risk and fight for it. I have never had someone put so much faith in me and trust our guidance every step of the way, despite having everything at stake. With their little girl here and another on the way they can finally call Australia home Others told me I was crazy and to accept the 482 but the moral of the story is we don’t take no for an answer, we fight for what we believe is right and the best outcome for our clients. We do not let clients throw money and time away if we can find a better pathway

03.01.2022 Hi Guys - just wanted to share as we have seen a huge increase in working holiday visa refusals and cancellations. So much for the department being lenient during COVID! The main reason for refusals is the work completed doesnt come under the definition of specified work - yes there is actually a definition! Particularly for Mining and Construction work you have to refer to the ANZSIC codes (links below). If it is not covered within the codes it likely wont count. Back i...n the day the Department were very lenient in terms of the relevancy and people got away with housekeeping and all sorts. This is not the case now and the department website particularly states cooking, catering and cleaning on a mine site is NOT eligible work. 03.01.2022 Happy long weekend Absolutely buzzing for my lil doll of a client - Got to call her yesterday with the amazing news that herself and her partner had gotten a year 408 (COVID) visa granted! It may seem straight forward but this couple were about to pay almost $10k for a ONE YEAR sponsored visa (because the employer wanted to save costs on their side) and their previous lawyer advised this was the ONLY option. They came to me and I told them they were absolutely mad to pay t...hat money and I could get them the same one year visa for FREE. I think they thought I was mad. Now they are off enjoying their long weekend and we got his skills assessment stage 1 through in record time and a lovely PR pathway set up - where their hard earned cash can be better used Remember guys there is more than one way to skin a cat and our goal is always to find the fastest, cheapest and most risk averse way to achieve your goals (No cats were harmed in the making of this post ). 03.01.2022 KCM 2nd birthday tomorrow I can’t believe it has been 2 YEARS!! It is amazing to see how far we have come and I could not have done any of this without the support of my amazing clients, particularly the Irish community 2 years ago I had a little medical scare that made me rethink everything. I upped and walked away from a job in a law firm - when I am ONLY an agent and should have been privileged to work there I sat at the kitchen table not knowing what I wanted to d...o. I was supposed to be resting but after a couple of hours I had thought of a name, logo, designed business cards, made a domain, created a website, registered an ABN, opened business bank accounts and all of a sudden I had a business I don’t do things by halves anyway and I did it all myself - with Gary Nolan cheering me on To be honest I had no idea how to run a business. I just knew I loved migration law and helping people who were in situations like I was in. I spent my days calling people and fixing the problems I actually wanted to fix - using my skills and specialized knowledge to help those who really needed it. I was hooked and this has been my driving factor since. It has been a roller coaster, but 2 years on I just want to say thank you so much to those who supported me from day one, who trusted me with their future before I had reviews and was not well known and to those that still go out of their way to sing my praises..you will never know how much this genuinely means to me and makes the battles all worthwhile.. to many more years changing lives and to always commiting to giving back to my community - I will never forget where I came from and those who supported me when I had nothing. 02.01.2022 Another travel exemption request approved today and my two tricky ones finally approved last week - after months of arguing and extensive submissions!! I cannot explain the happiness this brings me Because we are doing so well here in WA sometimes I think people forget we are in the midst of a global pandemic and even people who should qualify for an exemption are struggling. It is not realistic to try get someone in from overseas on a temporary visa right now unless they m...eet one of the grounds and have a strong argument - as difficult as this may be. Generally I specialize in skilled and partner visas and dont touch on the humanitarian side of migration but this area of work has been completely different and has brought me back to my Psychology days. My tenacity seems to work to my advantage and I have been fighting non stop for these people - one who was separated from her partner and forced to have an emergency termination at 16 weeks and medical negligence during quarantine. I cannot imagine what that poor girl has gone through and am so happy we could give them the gift of reuniting. Just wanted to share a little insight as sometimes it may look like I live the life of Reilly but rest assured I am constantly fighting for my clients and these wins are what mean the most to me. This new measure allows individuals to apply for the subclass 485 visa while overseas during the concession period and to be granted the visa while overseas (which was not previously possible).
