08.01.2022 In order for courts in NSW to continue with "business as usual", the NSW Parliament introduced a number of temporary changes to the Criminal Procedure Act (NSW), amongst others. One change is to allow greater access to judge-alone trials while jury trials are temporarily suspended. Recent decisions in the NSW District Court have emphasised the clear intention of parliament that the business of courts must continue where possible. The single test to be applied by the court in ...deciding whether a matter may proceed by judge alone is whether its in the "interests of justice". In the Local Court, things are pretty much back to normal with appearances in person the preference of the court. Things in the District Court continue to remain altered with more video court appearances and less jury trials running than pre-COVID. ...
