We don't normally like to appear conceited but one must ask, how a professional can engage in flippant comments, unhelpful opinion and incorrect assertions about a matter heading to court, in a practice area they are clearly unfamiliar with and even after being provided the legislation still can't see the error of their ways... we feel sorry for their client, not to mention the child the subject of the dispute thankfully too young to comprehend the ridiculous situation as it is. But how important are the 'best interests of the child anyway'

14.01.2022 CASE RANT: I found this a good read and highlighted the fact that not everyone (even those with celebrity status) get off easily for their criminal acts, a perception commonly frustrating Law-abiding citizens. The Judges comments which were repeated in the news article indicated her honour issued a warning to the offender via her solicitor (this is a legal requirement in NSW for appeals) that her sentence would likely be increased if the offender continued the appeal. ( (in... colloquial terms its a bit like saying quit while you are ahead) The Judge explained clearly and simply why the offender was already in a good position in terms of her sentence for fraud handed down last November, despite the offenders perception that the main offender (there was a series of offences with various people Involved) got a similar sentence and she should get less than the main offender did. The offender(s) committed fraud offences in a position of trust or using a public service entity (which theoretically means every taxpayer in NSW is an incidental victim) its an offence usually only explained away by greed, a conscious decision to deprive someone or to benefit themselves over others or the taking of some advantage (not an act of desperation or necessity which may be reasoned away or at least an explanation offered understand why it was committed). Such offences in NSW at least are increasingly leading to jail terms (or last chance alternative jail terms) . The original sentencing magistrate in this case has shown the offender leniency by suspending her fulltime custodial sentence, however, the offender still thought it was a harsh outcome and worth appealing. I think some offenders view home detention, suspended sentences and ICOs as NOT jail sentences so lesser punishment. Where as in the courts eyes its entirely the opposite... a suspended sentence effectively says YOU should be in jail, I have sentenced you to Gaol... but for xyz reasons Ill suspend it and let you keep your freedom The judge summed a similar thought up nicely by stating that this offenders suspended sentence has not really impacted her life dramatically and she still has a licence, her freedom and isnt forced into doing ordered activities (unlike the home detention order imposed on the main offender) I just think its absurd the offender even comprehended appealing the original outcome.

Strangulation is statistically a crime of passion I.e. its more likely to occur in an intimate domestic relationship that anywhere else.. given there can be such a fine line between life and death when strangulation is involved its at least encouraging to see the government recognise the significance of the act. #staysafe #whiteribbon #saynotoviolence
