25.01.2022 Why would you want a solicitor to look at your contract to purchase land before you sign? The better proposition is why would you sign a contract to purchase property before having a solicitor give you advice about what you’re signing. A solicitor can advise you on a range of matters concerning the contract, such as the inclusion of special conditions you may need to ensure your interests are protected, as well as information about the property you are purchasing and what goes along with it. 23.01.2022 At Klarich Legal we don't use a settlement agent to complete your matter. It's all part of our service and we use the latest settlement platform PEXA. The biggest benefit of this to you is cost savings - you aren't paying a third party for a service your solicitor should be able to deliver. It also means you stay in control of your matter. So when you are shopping around for a conveyancer or solicitor, be sure to ask them whether they use a settlement agent and how much extra that will cost.

22.01.2022 IF you are buying a home, you may need to play tax collector for the ATO. Previously, the purchaser didn’t need to know whether the vendor had to pay GST for the supply of a home but this has changed. The purchaser must now find out the GST position of the vendor and actually pay the required amount of GST direct to the ATO at settlement. This money comes from the vendor’s funds but don’t pay the GST and you, as the purchaser, could be liable. The vendor must p...rovide the purchaser with notice but make sure your representative understands this important change. GST is only applicable on new residential premises that is house and land packages, off the plan, display homes and new apartments or potential residential land newly subdivided blocks of land that are to be used to build houses on being sold by someone in the course or furtherance of an enterprise the supplier carries on. This includes a builder, property developer and so on. This change is designed to stop the practice of Phoenixing by vendor companies as a way of avoiding paying GST to the ATO! 17.01.2022 Stopping people selling property that isn’t legally theirs to sell is a major issue and one that is being addressed with the introduction of Verification of Identity laws. In WA, there were two notable instances where fraudsters were able to sell property while the legal owners were living overseas. The fraudsters, believed to be based overseas also, were able to arrange the sale of the Australian property with an agent, sign contracts and transfers, and direct that the money... from the sale be paid into offshore bank accounts. Unfortunately for the owners, once title passed to the unsuspecting purchaser that was it the property belonged to the purchaser and the owner was left without a property and without any recourse other than from the fraudsters but good luck finding them. It may seem like a nuisance but going through a verification of identity process with your solicitor is about protecting your biggest asset and avoiding the potential for fraudulent activity. To satisfy the requirements you will need either an Australia Passport or full birth certificate (an extract will not suffice). If are relying on a birth certificate and your name on the title is different because you have been married, you will also need to produce a marriage certificate (one issued by BDM, not the commemorative one you received on the day). You will also need a driver’s licence. Speak to your solicitor about what kinds of identity documents you need to bring with you.

12.01.2022 When a joint proprietor (owner) of land dies the surviving proprietor is automatically entitled to apply to have the property they owned with their late partner transferred into their sole name. A surviving proprietor application, known as an ASP, will need to be lodged and registered with Land Use Victoria before you can sell or deal with the property in the future. This is different to when two people hold property as tenants in common - when one person dies the other is not automatically entitled to the deceased's share. 11.01.2022 Before you sign a contract to purchase property it’s always a good idea to seek independent legal advice. The biggest benefit in having a lawyer look at a contract is that they know what to look for to ensure your best interests are protected. A lawyer can explain to you what the contract means, what the special conditions mean, what any restrictions on the land might mean and what you’re getting or not getting as well as answer any questions you might have. These days were... all in a hurry to seal the deal. But when you are buying a property, whether for investment or to live in, due diligence is essential. It’s a good idea, for example, to have the building or pest inspections done prior to signing or before the end of the cooling off period so you can end the contract without penalty. Buyer beware is most definitely the case with real property - when you sign a contract to buy a property you are purchasing the property as it is regardless of whether you can see any damage or not. And unless there is something in the contract saying a particular defect will be fixed before settlement, bad luck. Asking a vendor to repair something after the contract is made is much harder and the vendor would be within their contractual rights to say no. 08.01.2022 Well, the Christmas rush is certainly on - it is exciting and rewarding helping people move into their new home for their first Christmas there. At the same time, I am looking forward to a couple of weeks off because it has been a massive year with Covid-19 throwing all of our lives into chaos. 05.01.2022 If you are selling land in Victoria and your agent is preparing the contract, ask whether they are using the latest contract produced by the LIV/REIV. The 2019 Contract of Sale of Land is designed to replace the Contract of Sale of Real Estate which was once the mandatory contract agents had to use (it was prescribed by law, but this expired in 2018). The new version of the contract "has been painstakingly drafted and designed to maintain the rightful status of the LIV/REIV contract as the pre-eminent contract of sale of land in Victoria ... it is also designed to simplify document preparation and the conveyancing process" (Law Institute Journal, October 2019).

02.01.2022 Great news for those looking to build in NSW with the extension of the HomeBuilder scheme. This just in from Revenue NSW: "The HomeBuilder scheme has been extended to 31/03/2021 and applications need be lodged by 14/04/2021. For new build and substantial renovation contracts signed between 01/01/2021 and 31/03/2021, the grant payable is $15,000.00. The construction timeframe has been extended to 6 months for ALL HomeBuilder applicants.... Where the new build contract is signed between 01/01/2021 and 31/03/2021 the property price cap for NSW is $950,000." See more

02.01.2022 To avoid drownings in back yard pools, new laws have come into effect in Victoria designed to ensure private pools are maintained and continue to be compliant with the relevant laws and regulations. Councils will keep a register of private pools and will require pool owners to maintain a certificate of compliance through regular inspections. Most existing pools will need to be registered by the middle of this year. So what does this mean for those selling property in Victoria? Well, like your NSW neighbours, you will need to ensure the pool on your property is registered and compliant when it comes time to sell because prudent purchasers will be asking to see the compliance certificate. 01.01.2022 When purchasing a lot on an unregistered plan of subdivision there's a couple of things to bear in mind: 1. by default the developer has up to 18 months to register the plan of subdivision. You can't end the contract and obtain a refund on your deposit until this time has passed and before titles are issued because it is taking too long; 2. if it does take a long time to register, your unconditional finance approval may have lapsed leaving you to start over again and reapply... for a loan. Your personal circumstances may have changed, but you are still bound to complete the purchase or risk losing your deposit, and; 3. the value of the land may change - if it goes down your bank may not deem it to be enough security to cover your loan.
