24.01.2022 Case update Mentink v Olsen [2020] NSWCA 182 The Court of Appeal has unanimously dismissed an appeal challenging a decision of the Supreme Court that ordered a recipient of a $2.2 million gift repay that money because the transfer was unconscionable. The Court held that the primary judge made no error in his findings.... A woman suffering from a terminal illness made the gift in question to her daughter before she died. The funds withdrawn from a term deposit account were proceeds of the womans mother's estate and may have been assets of a partnership between the woman and her husband. Her husband commenced proceedings against the woman's daughter (his step daughter) alleging that she had obtained the money by reason of undue influence or unconscionability and was liable to repay that amount to the estate. The Court accepted the primary judges finding that the daughter initiated or contrived her mothers change of mind to her own benefit or took advantage of her mothers vulnerability in unconscionable circumstances. 16.01.2022 Judgment Just In: The Court of Appeal has dismissed an appeal brought by Ms Megerditchian who had successfully sought provision under the Succession Act 2006 (N...SW) out of the estate of her late father. The Court held that the question of adequate provision for the proper maintenance, education or advancement in life of the appellant was a discretionary decision which was fact-specific. It was for the primary judge to determine the weight to be given to the various factors set out in the Succession Act. There was no error established in the decision of the primary judge. 11.01.2022 The duties of an Executor of an estate include the following; The duty to arrange for the funeral of the deceased and arrange pay the reasonable funerals expenses. The duty to locate the Will of the deceased and prove the Will of the deceased by obtaining probate if they intend to accept the role of executor or administrator. ... The duty to make an inventory of the goods and chattels of the deceased, to collect and keep safe with reasonable care and diligence all the goods and chattels in the inventory and to insure estate assets. Likewise a trustee must preserve the trust property and carry out the terms of the trust including establishing trust for minors or testamentary trusts where appointed to do so and to administer such trusts. The Executor must follow the terms of a Will and defend the Will and any claims against the estate. There is a duty to pay any valid debts of the deceased not barred by statute. The duty to administer the estate as far as possible within the executors year and in a timely manner. The duty to render a true account of the deceased and lodge tax returns for the deceased and on behalf of the estate. The duty to distribute amongst the persons entitled to the estate under the Will or the laws of intestacy subject to family provision claim and the rules of forfeiture.

08.01.2022 When you die, your superannuation won't necessarily go to who you have nominated when you signed your super form. If it is not a binding nomination (which must be witnessed at the time of signing the form), the super trustee is responsible for deciding who gets your super. Sometimes this means that a de facto spouse receives your money instead of your children. There may also be unwanted tax implications. Binding nominations often lapse after three years and they become non...-binding. 01.01.2022 The wording that is used in legal documents is very important, and can often make the difference as to whether someone inherits part of a deceased persons' estate. In Blyth v Wilken [2015] WASC 486 - a Will was made in 2003 that gave the majority of the estate to the deceased's "de facto wife, Katherine Mary Murray". The couple parted ways in 2011 and the Will was never changed. Katherine Mary Murray believed that she still had claim to the estate as she was mentioned by nam...e, believing that "defacto wife" was only descriptive and had no other purpose. The Supreme Court considered sections 26 and 28A of the Wills Act 1970 (WA) and came to the conclusion that the deceased was only leaving the estate to Ms Murray because she was his de facto wife at the time the Will was written. The final decision was Ms Murray was no longer entitled to the gift as she was not his de facto wife on the day that he died.
