03.01.2022 NSW Transport Minister dishonest in defence of RDT for cannabis The detection window for cannabis is vastly wider than the impairment window. Most of the drivers who are found to be THC-positive during Australian RDT operations are unimpaired.... The evidence that many (and probably most) THC-positive drivers are not impaired is overwhelming. Despite that fact, the NSW Minister for Transport and Roads, Andrew Constance, has recently stated that Ultimately, if you’ve got [cannabis] in your system, like alcohol, you’re impaired. There’s no ifs or buts. That’s why you risk a hefty fine and 3-months immediate suspension on your driving licence. Constance made that evidence-denying statement in relation to an interview of former Magistrate David Heilpern by Waleed Aly (in the 7 July 2020 episode of ‘The Project’). Heilpern had recently retired from his job because he knew how inappropriate it was for him to keep penalising unimpaired THC-positive drivers. But Constance, as an evangelist for the War on Drugs, just didn’t care.
