25.01.2022 On 1 March 2021, new NSW regulations came into effect which brings residential builders and owner-occupiers under the NSW Security of Payment Act (SOPA). As a result, builders will need to be familiar with processes under SOPA in order to reduce the time to recovery of payment, and owner-occupiers (eg. mum & dads) will need to be prepared to respond to payment claims to avoid being blocked from participation in a subsequent adjudication. 23.01.2022 Biowood cladding is a Flame Resistant Reconstituted Wood Plastic Composite that was found to be made up of 70% reconstituted timber and 23% PVC. It had been used as an architectural attachment on the external walls of a large residential complex on 148 apartments in Ryde, NSW. The building owners alleged that the attachments were defective as they were combustible and failed to comply with of Building Code of Australia (BCA) and in breach of the warranties under the Home Buil...ding Act 1989 (HBA). 22.01.2022 On 17 April 2020, the Court of Appeal delivered a decision in relation to the controversial topic of reference dates under the Building and Construction Industry Security of Payment Act 1999 (NSW) (SOP Act). There was a unanimous decision delivered by Gleeson JA with whom Meagher JA and Payne JA agreed. The case in particular looked at the consequences of an Adjudicator making a determination outside of jurisdiction. 21.01.2022 The recent case of White Constructions Pty Ltd -v- PBS Holdings Pty Ltd [2019] NSW SC 1166, dealt primarily with a delay claim and the Court looked at different methodologies for assessing whether a project was delayed by an alleged delay event. The decision is a reminder that a Court will look closely at the facts and not just the opinion of experts. In line with heath advice the NSW Government has passed the COVID-19 LEGISLATION AMENDMENT (EMERGENCY MEASURES) ACT 2020 which commenced on 25 March 2020 The Emergency Legislation has introduced a number of temporary changes to 20 NSW Acts to deal with the effects of COVID-19.
