20.01.2022 *****8503 conditon waiver***** What is the 8503 condition? When you are issued an Australian visa, it carries certain conditions that must be met. The regulations state that conditions can be mandatory (they must apply to all holders of that visa) or discretionary - they may apply on certain circumstances determined by the decision maker. It is important that visa holders know and abide by all conditions placed on their visa as a breach will mean their visa is liable for canc...ellation if a decision maker so decides. An 8503 condition means that the holder will not after entering Australia, be entitled to be granted a substantial visa, other than protection visa while the holder remains in Australia. This means any other visa that they applicant tries to apply for will be unsuccessful as long as condition 8503 remains on their visa. If you have this condition you have one of two options: - leave Australia and apply from offshore, or - apply for the 8503 condition to be waived. Request for a waiver A visa holder must have a valid excuse or reason why their circumstances now (as opposed to at the time of the application) warrant the condition being waived to allow them to apply for another visa. We have just obtained a waiver allowing our clients who are elderly and considered high risk for Covid 19 to extend their stay in Australia.
