25.01.2022 WE HAVE SOME EXCITING NEWS! Happy Monday everyone. Dani & Shelby here, to shamelessly brag about our fellow lady crim lawyer, Erin, who has been announced as a finalist in the AUSTRALIAN Lawyers Weekly Women in Law Awards in the Mentor of the Year category. As two (of many) lawyers who have had the absolute privilege of being mentored by Erin, we could not pick someone more deserving of this achievement. Erin - as many of you know - tirelessly lifts others around her up, ...and offers so much of her time in mentoring younger (and older!) lawyers. We could not be prouder! Congratulations, Erin. You are such a winner in our eyes!

23.01.2022 NEW OFFENCE ALERT In Queensland, there was a new direction released today by the Chief Health Officer which creates an offence to intentionally cough, sneeze, or spit (or threaten to do any of these things) at a public officer or other worker. Keep in mind, it is also a criminal offence to do most of these things anyway. Were jumping on our stories this afternoon to explain this direction further.... We hope youre all keeping safe!

22.01.2022 INTRODUCTION TO DOMESTIC VIOLENCE PART TWO In order for the Court to make a protection order (DVO), the Magistrate must also be satisfied that the respondent has committed domestic violence against the aggrieved. A common misconception is that domestic violence relates to just physical abuse. However, the definition of domestic violence in QLD is so broad! It can include so many types of behaviours, including emotional, financial, or sexual abuse, or threatening/coercive ...behaviour. We have included some examples of the types of abuse that the courts have recognised as types of domestic violence-related behaviours (swipe across), but remember THIS LIST IS NOT EXHAUSTIVE. Given this broad definition, its so important to get advice from a trusted DV lawyer (*ahem*, us) if you are the aggrieved (or wanting to make a DV application) or named as the respondent to an application. 22.01.2022 Ever wondered what the QLD courts have to consider when hearing a domestic violence order (DVO) application? For a final order to be made, they must be satisfied on the balance of probabilities (i.e. is it more likely than not) that a relevant relationship exists, AND that domestic violence occurred AND that a final order is necessary or desirable. If youre thinking about making an application or if youve been served with one, get legal advice to discuss your case! We specialise in domestic violence law + can give you that specific advice.

16.01.2022 Weve had a promising decline in new confirmed cases of COVID-19. Our QLD home confinement restrictions are now easing slightly as of midnight tonight (i.e from 2 May 2020)! @Queenslandhealth have released some easy to understand fact sheets about these new changes on their website. Things are not back to normal yet! Make sure youre educating yourself about these new changes. Steep fines can still be issued for those people who breach the directions issued by the Chief Health Officer. We are jumping on our stories today to answer all your questions about these new changes.

Swipe across to see the very few exceptions where you can now leave your home. . It is now an offence to breach these directions. On the spot fines (of $1334 for individuals and $6672 for businesses) can be issued to those who contravene the directions. Yesterday, the ...first fines were issued by police in Brisbane suburbs. A press conference with the Queensland Police Commissioner earlier today indicated that people are dobbing on those who are contravening the directions. . Its important to know exactly what these new laws are because ignorance of the law is not an excuse and will not get you out of these fines. . Today saw the amendment of the Home Confinement Directions, its official - as of 12.01am Sunday 10 May the maximum number of visitors will increase from 2 to 5 persons from one household. And Monday sees kids heading back to school if they are in community kindergarten, prep, year 1, year 11 or year 12. @ Queensland

14.01.2022 WHAT IS AN ESSENTIAL/NON-ESSENTIAL BUSINESS? We addressed this question on our Instagram stories last night, and we have had quite a few people reach out for some advice about whether their business is essential vs non-essential (i.e. can they remain open at this time). A list of non-essential businesses has been published by Queensland Health. For the current list (at the time of writing) visit the link in this post. It is important to know that this is the FOURTH list t...o be published (i.e. it keeps changing and more industries are being added). So, keep yourself (and your business) up to date by visiting the Queensland Health website and checking this list. A reminder that it is now an offence for a business to continue operating if they are non-essential, and as a business you can be fined a significant amount for breaching the directions. It is also an offence for an employee to be working for a non-essential business (that is, you - as an employee - can be fined for going to work if your work is non-essential). Keeping in mind, even if you are an "essential business", you can only leave home to perform work IF that work cannot reasonably be performed from your principal place of residence. The onus is on YOU to ensure that you are following these directives. It is not an excuse to "not know" about these laws. We will continue to update you all on the list, and advise of any changes. 07.01.2022 Whilst the majority of Queenslanders took our Governments COVID-19 directions on board, there were a lot of fines issued over the long weekend to people who were not complying with the rules! Erin uploaded an article on our blog today about the fines issued by @qldpolice over the weekend. See the the link in our bio to read the article.
