This means that the funds cannot be dispersed to other members who are not listed or named as beneficiaries. To do so, would arguably undermine the very nature and purpose of a trust. While trusts are largely relevant to estate planning, as family lawyers we deal with trusts and complex business structures often, when assisting our family law clients divide their assets.
