15.01.2022 A year ago I shared the news that I started a law firm, but not the incredible person who I share it with. Brad is the other half of Laneway Legal! We started ...the firm together. Brad recently finished his senior role in the mental health sector and we’re both on deck full time. Aside from criminal law, Brad’s experience includes coronial inquiries, matters involving the Public Guardian, Public Trustee and Public Advocate, capacity and consent issues, Advanced Health Directives, substitute decision making, NDIS, Human Rights Act and some of the most complex Mental Health Court matters in the Supreme Court of Queensland. Together we have 20 years experience working in varying roles across the mental health and disability sector, particularly the intersection with the criminal justice system. We met working in this space and it’s an area of shared passion which we will continue in our business. 13.01.2022 Important message to the NZ Citizens who call Australia home... Today the Australian Prime Minister delivered a clear message to all New Zealand Citizens li...ving in Australia (his words).... If you are not a (Australian) citizen, and you violate our laws, then under my government's policies you will not be allowed to remain. You will be returned to the citizenship nationality, which is what I define as your 'home'." Those who were born in Australia, or have become citizens through our formal process - citizens of Australia enjoy the rights and entitlements and obligations of being citizens. No one else Anyone else who doesn't hold the title of 'citizen of Australia' does not get a special deal. Doesn't matter how long you've been here. It doesn't matter whether you turned up yesterday or many years ago What I know... Most reading this will be outraged and agree with the views of the NZ Prime Minister. The reality is that Australia has the right to make laws based on national security and the NZ government has no power to change this (they continue to try and influence). Young people are being deported too. If you have kids who are under 18, look to protect their futures early. There are cases of young people in their late teens and early 20’s being deported, after almost a lifetime in Australia. They are forced to a country they barely know and separated from the entire family unit. The government is not only serious about these laws and policy and following through, they are in the process of making the laws tougher (known as strengthening the character test and the Bill is before the senate). The way to protect yourself is citizenship. You may need to first explore your pathway to permanent residency and ultimately citizenship. It can be a long and costly but one well worth the investment for your families future. I know I am on repeat with this message. My passion for this comes from working with so many NZC families who are being torn apart by these laws. The ripple effect on an entire family and community is devastating. 11.01.2022 Info for NZ Citizens (families, workers and business owners) in Australia during times of COVID-19... ***On 30 March the government made an announcement about w...age subsidy for 444 vis holders (Kiwis). As soon as I have the official eligibility, I will update. What we know: NZ Citizens contribute billions of $$$ in tax in Australia and the only country granted temporary visas to live indefinitely in Australia. Many families, businesses and workers will be affected by the regulations that have been put in place by the government to respond to COVID-19. Most NZ Citizens have never needed to fall back on government assistance and not aware of entitlements. Here’s some info and links that may assist: In response to COVID-19, the government is providing a one-off payment of $750 to people receiving social security, Family Tax Benefit (FTB) and holders of some health care cards. Check out this link to see if you are eligible... https://www.dss.gov.au/abo/covid-19-information-and-support NZ Citizens who moved to Australia after 26 February 2001 and don’t hold a permanent visa, cannot access most ongoing Centrelink payments like Newstart Allowance for those who find themselves unemployed. There’s an exception for those who have lived in Australia for over 10 years. You may be eligible for a one off payment of up to 26 continuous weeks. 06.01.2022 New Zealand Citizens and Dual Citizenship If you’re an NZ citizen with a direct pathway to citizenship, consider it for the sake of you and your family’s... future. Some tell me they are a proud Kiwi and never want to give this part of them up. The reality - you don’t have to. When you become an Australian Citizen you remain a New Zealand Citizen. You automatically become a dual citizen and can hold both passports. You’re still a Kiwi at heart & still a Kiwi on paper My view, a pledge to Australia and a citizenship certificate does not change who you are, and doesn’t make you any less Kiwi. I think it shows you have made a decision to call Australia home and it allows you and your family the same rights, entitlements and protection that we have as Australian citizens. As a lawyer, I can’t emphasise enough, the importance of protection. The hardest part of my job is visa cancellations and removal (deportation). No family expects them, preparing the case and waiting for the decision is emotionally crushing and can be so damaging. I watch grandparents, parents, siblings, clients, partners and young children trying to cope with an uncertain future about their loved one. They are heartbreaking... Be PROUD Be PRACTICAL ... if you have a citizenship PATHWAY, seriously consider following it for the sake of PROTECTING you and your family’s future.
