09.01.2022 Same-sex marriage and the invalidation of previous Wills: On the 9th of December 2017, Australia passed legislation to allow same-sex marriage. Marriage is now classified as the union of two people and not restricted to just man and woman.... So what happens to all those marriages validly performed overseas before Australia became liberalized. They weren’t recognized before but they are now. Also we should consider that Marriage will invalidate an existing will. This raises the conundrum that any wills made by people in same sex relationships before the Australian law change, may well now be invalidated. Does the acceptance of foreign same sex marriages acknowledge them from when they were performed or merely from when we changed our laws and acknowledged them. Does the recognition invalidate all previous wills of same sex marriages? It is important you seek legal advice if you were married overseas before these laws came into effect. If you are in this situation, we recommend you at least review your situation and check the effectiveness of your documents .
