18.01.2022 The Family Court has made it clear in its recent publications that where you have parenting orders the parties are still to comply with those orders despite COVID-19 restrictions. Even if children are required to cross state boundaries which are closed there is a general exemption when it comes to compliance with court orders. If flights are not possible other forms of travel should be considered. If the orders cannot be followed the Family Court has indicated that the spirit of the orders must be followed. 15.01.2022 It appears that the general consensus amongst valuers of business for family law purposes is that it would be erroneous to apply a covid % discount for the current situation is not a reliable indicator as to where we might land. We don't know how long the situation will prevail or how deep the impact will be.

15.01.2022 Family Court of Australia and Federal Circuit Court of Australia Update to CDS interview protocol. As with all areas of the Court, Child Dispute Services (CDS) are endeavouring to find ways of conducting its work that ensures that assessments retain their value for litigants and the Court, while also minimising the risks to families and staff in the context of COVID-19. ... Interviews with adults are now being conducted by telephone or video. For assessments that have a child inclusive element, Family Consultants will consider whether this can also be done remotely. Where a remote interview is not possible or appropriate, and the assessment of children is considered to be critical and urgent, an in-person child interview and observation will still be conducted if the family is in a position to attend the registry. When this occurs the CDS In-person Interview Protocol will be followed.

14.01.2022 I would also like to introduce to everyone our para-legal third year law student Claire Taylor who has been working with us now for near 7 weeks. Claire provides us with terrific support and always has a beautiful happy smile. Below is a little more information about Claire which reveals how talented and dedicated to the law she is and how lucky we are that she is working with Laurier Lawyers. Claire is currently studying a Bachelor of Law and International Studies majoring i...n International Relations at Deakin University and is on track to graduate at the end of 2022. She is a high achieving student and was invited to join the Golden Key Honour Society which is only open to the top 15% of students. She has a wide range of experience including providing incorporation and insolvent trading advice in the Deakin Venture Law clinic as well as pro bono work interning for Julian Burnside AO QC with a focus on human rights and refugee law. Claire has strong advocacy skills developed while representing individuals in Unfair Dismissal Conciliations in front of the Fair Work Commission and came runners’ up in Deakin moot held at Clayton Utz. Currently Claire is working as an industry careers officer with the Deakin Law Student Society and as a legal intern for a cybersecurity firm.



13.01.2022 During my most recent signing appointments to witness Wills we have not been sharing the same pen. Please note, however, there is no requirement that the testator and witnesses use the same pen, although it is a well-established principle of prudent practice. The suggestion is that the use of different ink or ink of a different colour may indicate that the testator and witness(es) were not present at the same time. In view of the current hygiene requirements for COVID-19 if we don't use the same pen we include in our file note that the signatures at the signing appointment were made at the same time but with different pens.

12.01.2022 New Victorian government COVID-19 emergency regulations for the remote signing and witnessing of several important types of legal documents became law on 12 May 2020 and will overcome many of the problems caused by the current State of Emergency’s Stay at Home Directions. The emergency regulations are temporary and will sunset after 6 months. They allow many important legal documents such as wills and powers of attorney to be signed electronically and witnessed by audio-visu...al means. A person can sign the document remotely using an electronic signature and witnesses to the signing of a will or power of attorney don’t have to be in the physical presence of the person signing they can witness by audio-video conference provided that the detailed procedures set out in the regulations are strictly observed. Lawyers are still required to fulfill their ethical duties to act in their clients’ best interests and ensure that power of attorney and will signing is within the clients’ capacity and voluntary and does not lead to an increase in opportunities for elder abuse. The COVID-19 Omnibus (Emergency Measures) Act 2020 does not apply to the appointment of a medical treatment decision-maker or the making of an advance care directive. There is no relaxation of the strict legal signing requirements for these documents.

06.01.2022 After a long time of searching we finally can introduce to you and welcome our newest member of the team at Laurier Lawyers - Jamie Samuels is our gap student extraordinar who will work with us as our legal admin/reception until he commences uni next year to study law. Read on for a little more information about Jamie. Jamie graduated from Mount Scopus Memorial College in 2019 and is now going on to study a Bachelor of Laws and Bachelor of Arts (International Relations) at AN...U in 2021. During his time at school Jamie was passionately engaged in extra-curricular activities such as debating and public speaking competitions. He went on to win ‘Best Speaker’ on multiple occasions and finished as a finalist in the Baron-Sneider public speaking event. Jamie also held the role of School Portfolio Captain during his VCE year of school which involved coordinating educational and engaging programs for his peers. Since completing the subject legal studies in VCE, Jamie has maintained a keen interest in the legal profession, having previously engaged in work experience with one of Victoria’s top family law barristers and is now excited to be working for Laurier Lawyers. In his spare time Jamie is engaged in a complex logistical role as Boyzone and Volunteer Coordinator for the not-for-profit, Friendship Circle, as well as undergoing a year-long leadership seminar with Habonim-Dror Australia. Additionally Jamie has served in leadership positions within the Habonim-Dror movement, organising programmes and running camps for children of the movement.

04.01.2022 Wills in New Zealand can now be signed by audiovisual link, under the Epidemic Preparedness (Wills Act 2007 - Signing and Witnessing of Wills) Immediate Modification Order 2020. The order modifies s.11 of the Wills Act 2007, where it is impractical or impossible to comply during an epidemic, until the Epidemic Preparedness (COVID-19) Notice 2020 expires or is revoked. Australia has not yet followed suit.
