23.01.2022 On International Human Rights Day, the Law Council of Australia is calling on government to reassess its mandatory, indefinite detention of non-citizens who do not hold a valid visa. This policy, originally intended as a temporary and exceptional measure, has now been in place for decades and has resulted in prolonged periods of detention for far too many individuals who do not pose a risk to community health or safety. https://www.lawcouncil.asn.au//human-rights-day-isn-t-it-t



22.01.2022 The Law Council of Australia is calling for a comprehensive national response to address the vastly disproportionate imprisonment of Aboriginal and Torres Strait Islander peoples, 30 years on from the Royal Commission into Aboriginal Deaths in Custody (RCIADIC). In 1991, the Royal Commission concluded: The conclusions are clear. Aboriginal people die in custody at a rate relative to their proportion of the whole population which is totally unacceptable and which would not b...e tolerated if it occurred in the non-Aboriginal community. This occurred because too many Aboriginal people are in custody too often. 19.01.2022 The Law Council of Australia and the Australian Bar Association strongly condemn the ongoing intimidation, harassment, arbitrary arrest and incommunicado detention of lawyers and judges by Myanmar’s military (the Tatmadaw) since the unlawful coup d’état on 1 February 2021. We are concerned by credible reports of lawyers being detained for challenging the legality of their client’s detention, and for filing legitimate cases that the military considers undesirable. In addition,... judges at all levels of courts have been dismissed without valid cause, and some placed under unlawful detention. 15.01.2022 The Law Council of Australia invites comments and submissions by 7 December 2020 on a proposal for an Australian Solicitors’ Conduct Rule (Rule 11A Short-term legal assistance services). 13.01.2022 From today, migration lawyers will be able to offer services independently of the regulatory framework for migration agents, and all lawyers with unrestricted practising certificates will be freely able to provide immigration assistance in the course of legal practice. The discontinuation of dual regulation is in accordance with multiple major recommendations spanning many years and has been a long-held advocacy position of the Law Council. The removal of expensive and inefficient regulation of migration lawyers will improve access to justice by reducing costs for lawyers and therefore their clients. 05.01.2022 The Law Council of Australia is calling on the Federal Government to reconsider the enormous increase to the Federal Circuit Court fees for migration cases. Law Council President, Pauline Wright, said the jump from $690 to $3,330 will pose a severe threat to access to justice for migrants. 04.01.2022 A coordinated national approach to family, domestic and sexual violence, as recommended within the recently released final report of the House of Representatives Standing Committee on Social Policy and Legal Affairs’ inquiry into family, domestic and sexual violence, is a positive step in addressing this scourge on our community. Many of the report’s 88 recommendations aim to address the insidious and ubiquitous problem of family violence on a national level, which has been m...agnified by the COVID-19 pandemic. The proposal for a uniform national definition of family, domestic and sexual violence, is welcomed by the Law Council of Australia as it will go some way to addressing the confusion and complexity that arises from inconsistent legislative frameworks between jurisdictions and will assist in improved data collection.
