However most small-to-medium sized law firm Principals are not aware that it is highly likely the most significant risk in their practice is themselves(!) We can review, assess and attempt to mitigate external factors such as cyber threats, major client risks, professional indemnity risk and so on, but have you considered what happens to your firm if you were, as the saying goes, "hit by a bus?"... Your business continuity needs to consider such a scenario, with planning and consideration focused on the continuity of matters, potentially with the support of other practitioners. I also recommend firms consider insurances for the lives of Principals, including policies for Life, Total & Permanent Disability (TPD), and Trauma. Fancy an impressionable, presumably fairly new, 'Trainee' being asked this, let alone in a broadcast email........ "[Trainee's Name], unless you have been in suspended animation where you have absolutely no work, could you please find out how I discontinue a Training Contract halfway through where the trainee refuses/fails to carry out reasonable instructions from his principal?!" Just brutal! What a way to win friends and influence others! Given the breadth and depth of Mr. Oldham's public spray, I believe he needs to take a leaf out of Jocko Willink's and Leif Babin’s book, 'Extreme Ownership' and consider their theory that "there are no bad teams, just bad leaders." 19.01.2022 As we commence the first working day of another lockdown in Brisbane, I reflected on many a conversation from 2020 where clients quizzed me on the best way to engage with and maintain contact with their staff working remotely. "Face to face is the key", I would reply. Using Zoom, Teams or whatever system you have, use your technology and where possible, try to communicate with your people face to face, using video to ensure you can see them and they see you. Even a quick call..., use video to make the call and chat face to face. Try to minimise email and and other written communications where possible; I have written on a few occasions the perils of written communication. For teams leaders, try utilising daily 'Stand Ups' over Zoom or Team with your team members, even twice a day, to ensure everyone can communicate, share ideas, share struggles, offering the opportunity to assist or asking for assistance, just like they would normally in the office. 18.01.2022 Lawyers can be way too polite when it comes to fees and billing. Yes, maintaining client relationships is important, but do not let habits like discretion on billed WIP and fee discounting become the norm. 17.01.2022 I had the pleasure of attending yesterday's ALPMA: Australasian Legal Practice Management Association Lunchtime Seminar with Queensland Law Society CEO, Rolf Moses. Rolf delivered an exceptional workshop on Sexual Harassment and changing workplace culture in the legal profession. Rolf's presentation was not only informative, but it was also confronting to see real-life examples and the impact such events have on victims and workplaces in general. What is abundantly clear is t...hat things must change. I congratulate Rolf and the Queensland Law Society for their leadership in this space. The '5 Ds' of an Active Bystander were, in my view, great tips to reinforce that we all must play a part. In my recent presentation to the LEAP Legal Software AU Q&A Session, I outlined the important 'Lock Up' metrics legal practices should measure and manage on a regular basis. The slides attached show exactly how your firm's Lock Up is calculated, and a hypothetical example of a firm that improves their cash flow metrics by 70 days, meaning they have an extra $240,000 in their account this side of Christmas.... The simple way to look at your Lock Up is this.... If your Lock Up, like my hypothetical firm below, is at 116.8 days, the work you and your team are today, will not be paid by your client(s) until 7 March 2021. How does that sound to you? 15.01.2022 The Queensland Law Society has reported in Proctor that the Society has seen an increase in law firm principals accepting appointments as directors of law practices without doing sufficient due diligence. The obligations of an incoming Director of an Incorporated Legal Practice (ILP), in particular, are considerable and for many practitioners, maybe your first appointment as a Director of a corporation. It is not just a promotion and a new title. With it comes the obligations... and risks of being a Director in accordance with the Corporations Act 2001. Furthermore, due diligence for an ILP Director, in our opinion, should be more extensive, ensuring the company has applied due care and attention to the trust accounting requirements and compliance. 13.01.2022 "Cash is king." There's little point reporting healthy profits if the cash is not in your account. Therefore, regular monitoring and maintenance of your firm's 'Lock Up' is critical. Lock up is the percentage of your annual revenue (over a set period, say, a rolling 12 months) that has not been converted into cash yet. It contains two elements:... 1. Work In Progress (WIP) you have recorded and intend to invoice, and 2. Invoices you have issued and not yet collected (Debtors). As a percentage of your annual revenue, the result tells you the amount of time on average, from today, that it will take your firm to get paid for the work you're doing today. So if your lock up is 50%, that means, on average, the work you and your team are doing today will be paid by your clients in 6 month's time (50% of the year). 25% = 3 month's time, and so on. So obviously you want your Lock Up to be a low percentage. If your Lock Up is 'out there' then we need to chat. 12.01.2022 A client told me yesterday that I really took the wind out of his sails. He also said our meeting was 'sobering'. It was a Health Check of his practice. I did not feel his practice was in good shape. And like a doctor giving a patient feedback, I'm not going to give a clean bill of health when I concluded several areas of his practice were in dire need of attention.... 1. His staff were not being utilised effectively, 2. His cash flow was poor, 3. Costs were increasing over time, whilst fees were trending downwards. 4. His systems were archaic. None of this he knew until I put his practice under the microscope. 10.01.2022 Law firms: What's your 'Why?' statement? Does your firm have one? A 'Vision' or a 'Purpose'..... whatever your firm may call it. I call it a Why? statement and I challenge my clients to create their own unique 'Why?' as the context for their business planning. As Simon Sinek puts it, People don’t buy what you do; they buy why you do it.... For lawyers, this can be a difficult exercise, but I try and simplify it by asking my clients this question: 'What is the feeling experienced by your clients when you achieve a successful result for them?' Even in a conveyance, writing a Will, or a litigious matter......think about the emotions and feelings felt by your client after your firm achieves a great outcome for them from a well-executed, successful matter. 04.01.2022 By working with so many legal practices, I am privileged and humbled by some absolutely exceptional individuals I come across. Whatever role they have within a firm: Lawyer, Practice Manager, Legal Secretary, Reception.... there is an abundance of great people in this profession. However, I am too often saddened by the frequency of how people trivialise their important function within a firm, generally from the supporting elements of legal practices. "Oh, I can't do that, I'm... 'just a PA." "I'm just the Accounts Manager." There is no 'just'! Please remove this word from any sentence about yourself, your role and your importance. Take an Accounts Manager for instance: Payroll, Trust payments, creditor payments, Trust to Office transfers..... the lust goes on. How important is this role?!! It's crucial and anyone in it should know that the firm they work for would be in a bad way if your role were not performed optimally. McLaughlin & Associates is a great commercial law practice, based in Springwood on Brisbane's southside. After three months of hard work and discipline, a client of mine advised me this morning that we have now halved their Lock Up value over the three month period since 1 June 2020.
