Section 31 Sale Land Act provides, that a purchaser of land, that is not for industrial or commercial purpose and the land is not more than 20 hectares and is not used for farming, has a cooling off period of three days. However, the cooling-off period DOES NOT apply where:... the sale is by publicly-advertised auction the property is purchased within 3 clear business days before or after a publicly-advertised auction; the purchaser has previously signed a contract with the vendor for the same property in substantially the same terms; or the purchaser is an estate agent within the meaning of the EAA or a corporate body It is always important to know everything about the property you are purchasing. We would recommend that you do not enter into any contract until you have had a professional look over the Vendors statement and Contract of Sale and all your searches have been satisfied and you are sure of you finances.
