25.01.2022 New laws relating to off the plan purchases of property were passed by the NSW Parliament on 17 November 2015. The laws are aimed at protecting purchasers from unscrupulous developers who seek to rescind a contract before the sunset date and then re sell the property at a higher price. It is always important to ensure that you seek legal advice when purchasing an off the plan property so as to ensure you are properly protected.

Engineering business, Enjenia Services, has agreed to make a public apology and repay more than $17,000 owed to one of their staff, rather than endure litigation by the Fair Work Ombudsman, after admitting to terminating his employees contract without paying out his annual leave. They have agreed to take out an advertisement in the Herald and pay nearly thr...ee times the maximum penalty that could have been imposed if the matter had gone to Court. Why? Because litigation would likely have been much more expensive and thats before the fine was imposed! 15.01.2022 The Federal Coalition is calling for changes to existing laws or new tougher laws to better protect cyber bullying after Charlotte Dawson was hospitalised this week after she was attacked by Twitter trolls for naming and shaming Tanya Heti, a Monash University staff member who told Charlotte to #gohangyourself. Tanya Heti was subsequently stood down & directed to take leave without pay by her employer for sending the malicious comments to Dawson via Twitter. This incident... clearly indicates how careful employers and employees need to be when using social media sites. Employers should ensure that they have an effective social media policy otherwise, employers may find themselves being held responsible for the actions of their employees.

09.01.2022 Both employers and employees should heed the warning of FWA when it comes to social media by employees. Last year, an employee of transport company Linfox, Glen Stutsel, was dismissed for making derogatory comments about two of his managers on Facebook. FWA ruled that Mr Stutsels comments about the death of a Muslim terrorist were distasteful but still within his right to free speech and noted that Linfox did not have a social media policy in place and its induction training materials were inadequate grounds to sack the employee. It ordered Linfox to reinstate Mr Stutsel and pay him compensation. The decision was this week confirmed on appeal. A social media policy is an essential tool for all employers in the present age of social media and employees should be aware of the ramifications of their conduct.

02.01.2022 For all the mobile phone using drivers out there, TAKE NOTE! From 1 November 2012, the current mobile phone use rules will change. Currently, the rules allow a driver to hold a phone whilst driving but not make a call whilst doing so. Under the new rules, drivers are not allowed to hold or touch mobile phones other than to pass them to a passenger. Texting, video messaging, online chatting, reading preview messages and emailing are prohibited. You are allowed to use a mobile... phone for making or receiving a call, changing songs or using it as a GPS device as long as the phone is fixed in a secure mounting. Motorists caught holding a phone while driving will be penalised three demerit points and fined $298; $397 if in a school zone.
