25.01.2022 At the core of the "think like a lawyer" method is that there is usually more than a yes or no answer, and that there may be more than one correct answer. Most of us never question outside the rules of theory when given any decision needing to be made. If someone asks us what colour a wall is; and states 2 answers available being white or black; we will nearly always only choose between the choices provided. But what if the wall appeared white; but had a black undercoat.... Is the wall technically white or black? Or both? My point exactly! Does the question allow us to think beyond the basic conditioned theory of the question? We as humans can train ourselves to think outside regular yes-no patterns and the conclusions that follow from them, to get a gradation of answers which are applicable in any situation or set of questions. 24.01.2022 In 1996 I started looking for an articled clerk. I’d been running my own practice for 5 years. I interviewed up hill and down dale, and met many keen young people who had learned plenty of case-names by rote. Some of them were able to write a good essay. None of them, not a single one, was able to draft a simple contract.When I started my research for my Ph.D, I was fascinated as to the lack of practical training that law students received. I was not convinced that a law... degree should be solely academic, or that articles or PLT or Leo Cussen were the places to learn practical skills. I was also concerned that even bright students were learning by rote and that there was little debate about the big picture in law - which meant that students couldn’t get their heads around the reason for major policy debates or major reforms, whether reforms of corporate law, or of insolvency law, or with respect to the concept of intention in rape. Students couldn’t break down a problem into its little component bits, explain each bit and why it was important clearly and simply, and the propose a solution based on the analysis of each bit. My thesis focussed on practical skills.Because students couldn’t break the problems down into workable chunks, they often couldn’t analyse them to the sufficient degree to propose a solution which would deliver a good outcome to a client. Students needed some idea of what constituted a practical solution to be able to give the best recommendation. So I devised a method that teaches just that, and started a tutoring company. It's now demonstrably Australia's largest and most successful, with tutors in Melbourne Sydney and Brisbane and of course me on-line supervising everything and with regular travels to all three cities - next road trip between April 6 and April 10 covering Melbourne Sydney and Brisbane. 22.01.2022 So you have to write a long paper, maybe a thesis, maybe a dissertation, anything over 10000 words. In short, this is how you go about it. * Establish a clear research question. That is a point of view you want to prove, expressed as a question and an answer. * Establish a methodology. That’s how you want to prove your point of view. * Work out the argument by which you will establish your point of view. An argument is a series of logical propositions designed... to prove (or demonstrate) a hypothesis. * Intro chapter, introduce your topic, key concepts, methodology, thesis structure (that is, argument structure). * Each proposition forming part of your central argument, needs a separate chapter. * Think clearly. in particular, you have to clean up any major logical flaws in your argument, as they arise. 16.01.2022 A student asked me yesterday about my top three hates. I'm often asked to write people's papers. Not just provide a structure, which I can do, or edit, or point out flaws in arguments, but write the entire paper. I can't understand why people do that, to be honest. How do you possibly think that, in the future when you are working, your clients can have confidence in someone who couldn't pass her own exams?... I prefer to help people to think their way through the problems so that they can come up with the answers themselves, as they would in practice. Some students think it's ok to ask for cancellations or time changes at short notice. I have about 70 students in any one month and if they all changed their times the resultant chaos would mean that I couldn't help anyone. I prefer that students treat each session as if it were an exercise in court, where people are on time. And whilst your uni tuition covers uni tutors, it doesn't cover mine, so please be prepared to pay me. Some students have been with me for years throughout a part-time degree, and many are personal friends after it, but those who can't commit to time, can't make timely payments but want immediate service are not amongst that group.
