23.01.2022 ATTENTION: FIRST HOME BUYERS We are in trying times and there are not many properties for our First Home Buyers and there a low amount of offers for those Vendors who have their properties on the market. Agents are in unfamiliar territory with open for Inspections currently not allowed.... Over the last couple of weeks two new Purchasers, both First Home Buyers, have engaged our services to review a Contract, as they have only made an offer, NOT signed a Contract. When both documents were received for review, they had both signed a Contract, with no conditions to protect them, such as finance approval or building and pest inspections. FIRST HOME BUYERS, in fact all purchasers, please be very aware of the language that some Agents are using. The Making an Offer document is actually a Contract. Read what you are signing. Once the Vendor accepts your offer and signs the document, it is a BINDING CONTRACT. PLEASE do not sign any documentation with the Agent, despite how persuasive they are. They may tell you, they have a number of offers or the Vendor will not accept any offers after today. Do not sign. Arrange for the Agent to email the Section 32 Statement and Contract (if available) to our office and we will peruse the documents to ensure that everything is in order and advise you of what conditions must be included in the Contract to best protect your interests, such as finance approval and building and pest inspections. 19.01.2022 IMPORTANT INFORMATION RE GST VENDORS TO PAY GST AT SETTLEMENT FOR NEW DEVELOPMENTS - FROM 1 JULY 2018 New Federal legislation from 1 July 2018 has been implemented to reduce businesses in the property development area failing to remit the GST to the ATO after a sale settles.... The legislation applies to contracts that were executed on or after 1 July 2018 and those entered into before 1 July 2018 which will settle on or after 1 July 2020. OBLIGATIONS WILL IMPACT PURCHASERS AND VENDORS ALL VENDORS of residential property are required to provide a GST notice stating whether GST is to be withheld at settlement. Failure to comply with the withholding legislation is an offence and will attract criminal and administrative penalties. The liability for the GST remains with the Vendor and there are no changes to how the Vendors lodge their Business Activity Statement (BAS). When the Vendor submits their BAS and it is processed, the Vendor will receive a credit of the amount the Purchaser withheld and paid to the ATO. The GST amount payable is typically:- 1/11th of the Contract price; or 7% of the Contract price where the parties have agreed that the margin scheme applies. EXCLUSIONS: All commercial property Established residential property Renovated residential property Retirement Villages Business to business supplies of vacant residential land where the purchaser is registered for GST. 19.01.2022 OFF THE PLAN PURCHASE Before signing a Contract to purchase a property Off the Plan, it is imperative that you have a qualified and experienced Conveyancer peruse the Contract and explain the document to you and the risks involved with buying Off the Plan. We have seen many a Purchaser disappointed and frustrated and at times find themselves in a difficult situation, as settlement did not occur when they expected.... Settlement of an Off the Plan Contract will usually be 14 days after registration of the Plan of Subdivision. It is difficult to estimate when settlement will take place as there is a great deal of work to be done before a development is completed by the builder, service providers and authorities. Inspections and approvals by Council are also to be carried out. Contact Advantage Conveyancing for a review of an Off the Plan Contract, before signing any documentation. Get the protection you deserve by engaging a qualified and experienced Conveyancer.

17.01.2022 BUYER BEWARE DURING STAGE 4 LOCK DOWN If you are purchasing during these unprecedented times, you must ensure that the Contract contains Special Conditions to best protect your interests. Your loan approval time frame should not lapse until after 13 September, 2020 (or longer, should Stage 4 be extended), as Lenders are taking longer to process applications and valuers are not permitted to attend to carry out valuations.... Building and Pest Inspection clauses should not expire until after lock down, as inspectors are also not permitted to attend properties. It is also advisable to include a COVID19 clause. 13.01.2022 There has been some justified bad press regarding PEXA, in recent weeks. Property Exchange Australia is an electronic settlement platform that will be mandatory from 1/10/2018. This private company is owned by the 4 Major Banks, the Victorian State Government, Macquarie Bank and a Private Investor. At this time it is the only electronic platform available, although there is a welcomed competitor on the rise - Symplify. Despite ongoing service issues there has also been at ...least one proven breach of security and a Vendor's funds misappropriated. We are pleased to note increased security has been implemented by PEXA. Nonetheless it is the practice of Advantage Conveyancing to continuely run checks on all our PEXA matters to ensure that our client's funds are protected and directed to the correct destination. At Advantage Conveyancing, we operate a Trust account so that our client's funds are held by us and protected until distributed at the time of settlement. The alternative is clients funds are deposited into "A slush PEXA account" with 1000's of other customer funds, days before the settlement date. We have received reports of funds not being acknowledged or apportioned for several days. For the protection you deserve - engage the services of Advantage Conveyancing.

Our office is a separate building on a private property, so we are not in a shared office building or shopping strip and can therefore continue to operate from our office. Staff are working in shifts, so that social distancing is observed. We do not want staff to work from home and subject our clients to cyber crime where internet services do not have the protec...tion that we have in place in the office to phishing and other infiltration. 06.01.2022 The Victorian Government has announced this week that they will contribute (or us tax payers will), $600 million to the Cladding disaster. The State Government is expecting that the Federal Government will foot half the Bill but this is unlikely. Combustible Cladding is not just an issue for Victoria, the problem extends Australia and worldwide. We have attached the Victorian Cladding Taskforce Report and comments by Barry Nilsson Lawyers.... If you intend to purchase an Apartment or a dwelling with external cladding, you must carry out investigations as to whether the cladding is combustible. If purchasing an Apartment check the Section 32 Statement and the Owners Corporation Certificate for details of any Notice or Order issued....... Or Have an experienced Conveyancer peruse the documents for you, before you make an offer.

03.01.2022 You may have heard that there are proposes to change sunset clauses in Off the Plan Contracts. Should the proposed changes be passed, they will take affect from 23 August, 2018. The changes are to Sections 10A 10E... The Vendor will not longer have an opt out provision. The new sections will provide that rescission can only be effected by the Vendor subject to: written consent being obtained from all Purchasers after providing the Purchasers with 28 days notice specifying the particulars for rescission should the Purchasers not agree to the rescission, the Vendor can apply to the Supreme Court for an order permitting rescission but must show just and equitable reasons for rescission. The matter is now not expected to be discussed by Parliament again, until after the State election. We shall keep you informed as to the decision.

02.01.2022 Consumer Affairs Victoria ruled earlier this month that they would not enforce standard General Conditions to be attached to Contracts for the sale of land in Victoria. General Conditions are still required, however this ruling leaves it open for General Conditions of choice, to be included in Contracts. This will create confusion in the industry, as a standard set of General Conditions will no longer apply to all Contracts.... When Advantage Conveyancing prepare a Section 32 Statement for the sale of a property, we will provide a Contract of Sale, that includes General Conditions that have been approved by the Law Institute of Victoria and the Australian Institute of Conveyancers (Vic), to best protect the interests of our Vendor client. When perusing a Contract for a Purchaser, we can no longer rely on the General Conditions being standard and will need to read all General Conditions, which will prolong the process and may lead to a charge for Contract advice.
