20.01.2022 General Skilled Migration and Business Visa - Temporary Closure - Covid 19 Over the past few days there has been announcements made from various states that they are currently closed for Skilled points migration and business visa nominations. Please review the following statement from the Migration Institute of Australia. *** 2020-21 Migration planning levels and allocations ***... As members will be aware the Federal Budget has been deferred until 4 October 2020 due to the impact of the COVID 19 pandemic. This has implications for all government departments dependent on the financial allocations made as part of the Budget decisions. An economic and fiscal update will be provided by the Treasurer on 23 July 2020. It is expected that the Department will consider changes to the Migration Program Planning Levels for 2020-21 due to the COVID-19 situation and higher levels of unemployment within the Australian workforce. Migration numbers and state/territory nomination places have also been impacted, as well as the announcement of any changes to the occupation lists. In the interim, the Department has indicated that the 2019-20 Migration Program settings will remain in place until further notice and will also shortly announce how state/territory nominations will be managed in the lead up to the October Budget. States & Territories migration programs The General Skilled Migration (GSM) program for the 2019/20 financial year has now closed. The State and Territories nomination program will remain temporarily CLOSED until the Commonwealth Government allocates state nomination places for 2020-21. State & Territory governments therefore have no ability to nominate applicants in visa subclass 190 & visa subclass 491. Business visa program are also closed in all states, although WA has not confirmed this on its website. While the Immigration SA website states that the allocation will be made to the States and Territories in early August 2020, this has not been confirmed by the Department.

05.01.2022 *** Subclass 408 Visa - Covid Stream*** The Department of Home Affairs has announced a new visa stream to allow holders of temporary visas who are engaged in or have the relevant skills to undertake critical work relating to supply of essential goods and services. The purpose of the instrument is to provide a pathway for certain former and current holders of temporary visas to lawfully remain in Australia and who would otherwise be required to depart Australia who, but for t...he COVID-19 pandemic, are unable to leave Australia. Criteria - Must hold a visa that is 28 days or less from ceasing to be in effect - Or, held a visa that is no more than 28 days from ceasing to be in effect - And, are unable to apply for the same temporary visa they hold or held or any other subclass of temporary visa other than the Subclass 408 visa. It is our understanding that such persons would have Subclass 485, 457/482 and Working Holiday visa holders. Must be part of response to workforce shortages during the COVID-19 pandemic in relation to areas including, but not limited to, agriculture, aged care and public health. Peter Dutton MP Minister for Home Affairs JOINT MEDIA RELEASE Thursday 19 March 2020 BORDER RESTRICTIONS Australia is closing its borders to all non-citizens and non-residents. The entry ban takes effect from 9pm AEDT Friday, 20 March 2020, with exemptions only for Australian citizens, permanent residents and their immediate family, including spouses, legal guardians and dependants. New Zealand citizens who live in Australia as Australian residents are also exempt, as are New Zealanders transiting to New Zealand. Exemptions for Pacific Islanders transiting to their home countries will continue to apply. Australian citizens and permanent residents and those exempt from our entry restrictions will continue to be subject to a strict 14 days self-isolation. Our number one priority is to slow the spread of coronavirus to save lives. Our government has taken this unprecedented step because around 80 per cent of coronavirus cases in Australia are people who caught the virus overseas before entering Australia, or people who have had a direct contact with someone who has returned from overseas. Our previous travel and entry restrictions have already meant that daily travel to Australia by non-citizens has been reduced to about one third of what it was this time last year. We also strongly urge Australians looking to return home to do so as soon as possible. This follows our upgraded travel advice for all Australians not to travel overseas, at all." 01.01.2022 ***Government assistance for temporary visa holders*** The Government has addressed their assistance for those who are on Student and work visas. Student visas... 1) Students who have been here longer than 12 months who find themselves in financial hardship will be able to access their Australian superannuation 2) The Government will assist in the education sector to reduce school fees. 3) students are able to access extended hours if they are working in aged care and supermarket. This extension ends on 1st May 2020. Skilled work visas subclass 482 1) you will be able to extend your visa if you were stood down (not laid off) 2) you will not be breaching your conditions if your hours have decreased. 3) access to your superannuation for this financial year ($10,000) 4) those who have been laid off and are unable to find a new sponsor should exit Australia so you don't breach your visa condition. However, if you were to be re employed after the Pandemic your time working in Australia will be counted towards your PR application. Working Holiday visas To support the critical sectors of heath, aged and disability care, agriculture and food processing, and childcare, some limited flexibility will be provided. You will be exempt from the 6 months employment condition if you work in the critical sector. We suspect there will be more issues addressed after Tuesday's cabinet meeting.
