21.01.2022 Back in August 2017, when the Relationships Register Act 2016 came into effect, it changed the way same-sex couples could guarantee their rights could be recognised in South Australia. However, with the change to the definition of marriage in the Marriage Act, the impact of the Relationships Register Act was significantly lessened. However, it is still an option for couples who wish to have their relationship legally recognised, but don't want to go through a 'marriage'. We often describe a 'Registered Relationship' as a 'civil union', as distinct from a marriage. In the case of both a marriage, and a registration of a relationship, you will need to immediately update your wills, as the marriage or registration automatically revokes your will, in most circumstances.

19.01.2022 Has someone appointed you as the Executor of their Will? If so, there are a few things you should know. 1. Where is the original Will? How will you be able to access it if they die? 2. What are their wishes in relation to their funeral? 3. Do they want their bodies cremated or buried? Do they want to be organ donors? 4. Where are their assets held? Do they have shares, savings, real estate? Do they run a company, and if so, who is their tax accountant?... 5. Do they have Trusts? Who manages these? These, and other matters, are critical issues for an Executor to determine, and you might not get much time to sort them out. It's very important that you do so now. If you have any questions, you should make an appointment to speak to one of our experienced solicitors, who can point you in the right direction.

11.01.2022 From 1 August 2017, the Relationships Register Act 2016 came into effect, allowing couples in South Australia to register their relationship, regardless of their gender or sexual identity. Registering a relationship can be done with an application form available from Births, Deaths and Marriages, but doing so will revoke any previous Will you have made. Therefore, we recommend that you seek advice about your Wills either before you register your relationship, or immediately ...afterwards. The Act also changed the way estates can be challenged, by changing the requirement for domestic partners (who are not married) to prove their relationship. It also affected your rights to be named on a child's birth certificate, claim superannuation, and other matters. Have you reviewed your Will recently?
