24.01.2022 Important and Friendly reminder: If you receive an email or phone call from ANY company requesting personal information and/or bank account details, please do not provide this information. Hang up the phone and call a known number to the business who allegedly made the call. If it was in fact them, they will have records of the call in the system. Scammers are good at what they do and calls and emails can seem genuine. Always be alert to such crime and protect your assets and identity.

Further, a record should be kept on items which have been previously broken and repaired, to ensure that the repairs have not deteriorated, resulting in a foreseeable risk of injury.

21.01.2022 INDEPENDENT SOLICITOR’S CERTIFICATE FOR GUARANTOR ADVICE. Banks and Financial Institutions often require a Guarantor for borrowings (with or without security), especially where an entity is involved; LVR requirements aren’t met or there are different parties named as Borrowers than appear on security documents. In these instances, a common requirement is for the Guarantor to obtain Independent Legal Advice from a Solicitor that holds an unrestricted Practising Certificate and that is not acting for a party on the transaction (be it a purchase or a refinance etc). 21.01.2022 A friendly reminder about the importance of getting all elements correct on a Contract - in particular the Buyer’s name. Often I see that a keen and enthusiastic Buyer has signed a Contract without legal or financial advice. It is later uncovered that the Purchasing Entity or Buyer’s name is not correct and needs to change. For example, a Buyer has signed a Contract with the Buyer being themselves in their individual capacity, when really they needed to have purchased in th...e name of their Company or their Company as Trustee for a Trust. This is not as simple as agreeing to change the name. It means a whole new Contract in order to avoid double duty. This opens the Buyer up to risks associated with the Seller as well. Give me a call to help you feel comfortable in knowing that all particulars to a Contract are correct before you sign.

Please be aware that the default registration period (and the period for many migrated registrations) is seven years.... Therefore, registrations made in 2012 will begin to expire this year. Check on any secured interests you may have and ensure that you extend the expiration period BEFORE the expiry date.

These include the provision of certain disclosure, obtaining legal and financial advice and time frames for being able to sign. 09.01.2022 Federal Court scam warning 13 July 2016 The Federal Court has warned of a potential virus or malware threat in emails purportedly sent by the court. An information statement released by the court says:... The Federal Court has been contacted by a large number of people who have received emails, purportedly sent by the Federal Court on behalf of the Federal Circuit Court, subpoenaing them to attend court at a specified time. The email also requires the recipient to click on a link to both the court address and case related information. Neither the Federal Court nor the Federal Circuit Court issue subpoenas in such an informal way. These emails have not been issued by the Court and are fraudulent. Most importantly, anyone receiving such an email should not click on any of the links as they may contain viruses or malware. The Australian Federal Police (AFP) has also issued an alert on similar emails using the AFP logo.

During the course of a transaction, I get to know a lot about my clients so I thought I would share a personal tidbit once a week so that you can all get to know me.... Week 1. I grew up in a coastal town in Central Queensland called Yeppoon. When I left school, I did a year of performing arts at university in Rockhampton . Those who know me well know I am about 90% introvert and 10% extrovert, so this was maybe not the best choice of degree for me (which is why I only lasted a year)!

"Pre- Approval", although an indication of how much you can borrow is in no way a guarantee that you will be formal...ly approved by your financial institution. Pre Approval should only be used as a guide for the maximum amount you may be able to borrow. When negotiating Contract conditions, it is important that you discuss all possible conditions (such as finance approval), with your solicitor, before you sign the Contract to ensure that you are not exposing yourself to unnecessary risk. 03.01.2022 One year ago today, I was admitted as a solicitor in the Supreme Court of Queensland. Although having many years experience prior to admission, I have learnt so much over the last twelve months and have created many special relationships with clients and associated professionals. Often we see that a keen and enthusiastic individual has signed a Contract without legal or financial advice and makes contact with our firm part way through the matter to explain that the entity details or name on the Contract is not correct and needs to change. For example, a person buying property has signed a Contract noting the Buyer being themselves in their individual capacity, when really they needed to have noted the Buyer as their Company ...or Company as Trustee for a Trust. At this point, it is not as simple as agreeing to change the name. It means rescinding the existing Contract and re-entering into a new Contract. It is highly recommended to that all Contract be checked prior to execution and this is a service which I am more than happy to provide.

01.01.2022 FINCH LEGAL TURNS 1!!!! I have been sitting on this post for a week now, wondering how I can ever convey my gratitude to the people who have supported me over ...the last 12 months. I have figured out I cannot express it in words, but I will have a go. My decision to start my own business was a quick (and absolutely terrifying) one, that involved quite a bit of pushing from some pretty awesome family and friends.
